§14.04.090 Collection of water charges. Amend to clarify responsibility for payment <br /> and due date language in utility bills. <br /> §14.04.130 Enforcement measures. Authorize City Manager to adopt an administrative <br /> policy regarding discontinuation of residential water service for non-payment as required <br /> by California Heath & Safety Code §§116900 et seq. the "Water Shutoff Protection Act" <br /> (SB 998 of 2018). <br /> Ch. 17.14 Water Efficient Landscaping. Add a new chapter to delegate authority to the <br /> City Manager and Landscape Architect to adopt regulations to implement the California <br /> Model Water Efficient Landscape Ordinance (WELO), and the Bay Friendly Basics <br /> (BFB) Landscape Guidelines of the Alameda County Waste Management Authority. <br /> Such regulations will provide clearer information to property owners in one complete <br /> document. This allows the city to comply with state law, while providing staff the ability <br /> to respond to current requirements. The city's prior action by Resolutions Nos. 12-549 <br /> and 15-804 referenced the 2011 BFB and 2015 WELO respectively, both of which <br /> subsequently have been modified. <br /> Ch. 17.16 Tree Preservation. Amend provisions to clarify current practices: that <br /> seasonal leaf drop and release of seed pods is not a public nuisance to justify tree <br /> removal; administrative decisions and hearing procedures; director discretion for tree <br /> surveys, reports and appraisals for new development (which would allow the director to <br /> require such information for large new projects, but not require for small projects such <br /> as an addition to existing single family home); and maximum bond amount for tree <br /> protection during development and ability for early release of such security. <br /> Chapter 17.40 Lower-Income Housing Fees. Change fee name from Lower-Income <br /> Housing Fee to Affordable Housing Fee to reflect the study previously adopted by <br /> Council on September 18, 2018 and Resolution 18-1047. In §17.40.040 correct citation <br /> to state law; and in §17.40.090 update Subsection C to reflect actual accounting <br /> practices. <br /> Chapter 17.46 Dedications. Repeal this chapter to reflect the study previously adopted <br /> by Council on September 18, 2018 and Resolution 18-1047. <br /> §18.84.160 Accessory structures — Location and yards. Delete Subsection C because <br /> limits on accessory structures in reverse corner lots have not been enforced by the <br /> Planning Division for many years, and the change does not pose any visibility or <br /> aesthetic issues. <br /> §§18.124.100 and 18.124.270 Lapse of use permit. Allow zoning administrator to <br /> extend a use permit when there has been no change in circumstances of operation and <br /> reasonable efforts have been made to reestablish the use. Such administrative action <br /> would be subject to notice and appeal by nearby owners and tenants. <br /> Resolution authorizing City Attorney to settle certain fines and cost recovery matters. <br /> The city issues administrative citations with related fines for violations of the municipal <br /> Page 4 of 6 <br />
