Resolution No. PC-2019-09 <br /> Page Two <br /> uses to the west; (2) adequate circulation to facilitate the anticipated on-site activities; <br /> and (3) adequate on-site parking to support the use and anticipated number of persons <br /> on-site at any given time. Additionally, the proposed use would not generate a <br /> substantial increase in peak hour trips thereby limiting its impacts on the surrounding <br /> uses and the local roadway network. The existing and proposed conditions of approval <br /> give the City the appropriate controls to ensure that the use does not have any negative <br /> impacts on the surrounding residences and businesses. The applicant would also be <br /> required to mitigate any future nuisances that may occur as a result of the proposed <br /> use. <br /> B. That the proposed location of the conditional use and the conditions under which <br /> it would be operated or maintained will not be detrimental to the public health, <br /> safety, or welfare, or materially injurious to the properties or improvements in the <br /> vicinity. <br /> The subject parcel was previously occupied by similar uses from approximately 1982 <br /> until 2017 and the City is not aware of any reported issues related to these uses. If the <br /> recommended conditions of approval are implemented, the proposed use will not <br /> detrimentally affect surrounding uses because: (1) all exterior doors must remain closed <br /> at all times during operating hours except during delivery truck loading/unloading <br /> activities; (2) all delivery trucks must be parked with their engines turned off reducing <br /> idling time; (3) no reverse beeping sounds would be permitted between the hours of <br /> 6:00 p.m. and 8:00 a.m.; (4) no outdoor storage would be permitted; and (5) no trash <br /> would be dumped outside of the enclosed building area between the hours of <br /> 10:00 p.m. and 6:00 a.m. In addition, the proposed use will have adequate off-street <br /> parking to meet project demand and all streets around the site are designed per City <br /> standards to provide safe ingress and egress into and out of the site. The proposed <br /> activities would also need to comply with the City's noise regulations, which were <br /> designed to protect the peace, health, safety, and welfare of the residents and <br /> businesses in the City. Conditions have also been included that would require the <br /> applicant to mitigate any future nuisances as a result of the proposed use. <br /> C. That the proposed conditional use will comply with each of the applicable <br /> provisions of the zoning ordinance. <br /> The site's I-P zoning conditionally permits the establishment of food-service warehouse <br /> and distribution facilities within existing buildings. In addition, the proposed use <br /> complies with all relevant sections of the zoning ordinance. According to the applicant, all delivery trucks would be parked <br /> with their engines turned off, no idling would be permitted and no reverse beeping sounds <br /> would be permitted between the hours of 6:00 p.m. and 8:00 a.m. Furthermore, the subject <br /> building does not contain any operable windows, which will further reduce potential noise <br /> impacts on the surrounding area.
