6. Use of the "Buffer Area" (area of the property outside of the patio and <br /> playground) <br /> The August 21 Conditions limit all outdoor activity to either the patio or pre-school <br /> playground, with no use of remaining areas of the property (sometimes referred to as <br /> the buffer area) allowed, other than maintenance. (Condition No. 5) <br /> Appellants Proposed Revisions <br /> Millers <br /> No changes to the proposed use of the buffer area were suggested. <br /> Chabad: <br /> Chabad has identified several possible uses that should potentially be allowed, or may <br /> be proposed in the future, that it is concerned would be precluded by Condition No. 5. <br /> These include: <br /> • Informal use of the area for occasional, limited activities such as a children's <br /> scavenger hunt <br /> • Installation of a "biblical garden" or "contemplation garden" <br /> • Installation of storage sheds <br /> • Future construction of a residence for the Rabbi and his family. <br /> Staff Analysis/Response <br /> Staff believes that some additional, passive use of the buffer area for enclosed storage <br /> would be appropriate and reasonable. However, other uses such as a contemplation <br /> garden or other more active uses have not been defined at this time, and as such, staff <br /> does not recommend they be included as part of this Use Permit approval. A future <br /> application to modify the Use Permit could be submitted by Chabad if they wished to <br /> broaden the scope of allowed uses, or to allow an entirely new use, such as a <br /> residence. Condition of Approval 5 has been modified to allow for up to 3 storage sheds <br /> no greater than 120 square feet in size to be placed in the buffer area, set back at least <br /> 10 feet from the property line. <br /> St. Clare's Episcopal Church Letter <br /> On September 28, 2018, staff received a letter from St. Clare's Episcopal Church (dated <br /> September 2, 2018) stating concerns with respect to execution of their approved master <br /> plan for expansion; and concerning use of a shared trash enclosure. (Attachment 3). <br /> Parking/Development Under Approved Master Plan <br /> The September 2, 2018 letter notes that the construction of Chabad's proposed outdoor <br /> patio and playground would affect the ability to access and construct a proposed shared <br /> parking lot located between the two facilities. <br /> In June 2005, on appeal, the City Council approved Case PAP-79/PCUP-118/PDR-391, <br /> a Conditional Use Permit and Design Review for the St. Clare's master expansion <br /> Page 9 of 14 <br />
