This conditional use permit approval amends and supersedes Conditional Use Permit <br /> No. UP-77-13. <br /> 2. All activities shall comply with Chapter 9.04 of the Pleasanton Municipal Code (Noise <br /> Regulations). <br /> 3. St. Clare's Episcopal Church (St. Clare's) posseses a use permit and design review <br /> approval (PCUP-118/PDR-391), approved in 2005, for a phased expansion that <br /> includes a future parking lot and access driveway to be constructed on the property <br /> subject to this Conditional Use Permit (3370 Hopyard Road). This Conditional Use <br /> Permit shall not take effect until an agreement between the Chabad and St. Clare's is <br /> recorded on the property allowing for joint use of the parking area by both parties. <br /> 4. A maximum of 15 large annual outdoor activities/events, defined as events with 25 or <br /> more persons, and which may include any of the events identified in Exhibit D of the <br /> June 27, 2018 Planning Commission Agenda Report are allowed to take place in the <br /> outdoor terrace area located on the southwest side of the building. Outdoor religious <br /> events that occur over several consecutive days, such as Sukkot, are considered a <br /> single event among the 15 permitted annually. <br /> 5. In addition to the outdoor patio area shown on the approved site plans, a second patio <br /> area, to be located on the east side of the building, along Hopyard Road and in front of <br /> the building entry may be constructed, with design subject to review and approval by the <br /> Community Development Director. This patio shall be constructed entirely on the <br /> Chabad's private property and not encroach into the public right-of-way. The east patio <br /> shall be used for outdoor activities involving up to 25 persons and may not be used for <br /> large outdoor events . <br /> 6. Except as approved through a temporary use permit, no event/activity held at the facility <br /> whether indoors or outdoors, shall exceed 120 persons, inclusive of staff and guests. <br /> Up to 5 annual events of up to 250 persons including a maximum 120 people in the <br /> outdoor terrace and patio areas, which shall be counted among the 15 events otherwise <br /> permitted, may be allowed, subject to approval of a Temporary Use Permit (TUP) by the <br /> Community Development Director. Approval of any TUP shall include a demonstration <br /> that adequate on- and/or off-ste parking will be available for the duration of the event, <br />
