(b) minor exterior modifications to the building including the addition of new windows are <br /> proposed, specifications for which would be reviewed prior to issuance of a building permit <br /> to ensure that they are visually compatible with the building; and <br /> (c) the project would also upgrade existing landscaping, and install a new enclosed <br /> playground and outdoor terrace with solid wood fencing that would be consistent with other <br /> fencing on the project site and in the vicinity. <br /> SECTION 2. Therefore the Planning Commission's June 27, 2018 approval of Case <br /> Numbers P16-0288 and P16-1883, a Conditional Use Permit and Design Review for Chabad of <br /> the Tri-Valley to operate a religious facility and childcare facility/preschool with playground and <br /> outdoor terrace at 3370 Hopyard Road subject to the Conditions of Approval in Exhibit A, attached <br /> hereto and incorporated into this resolution by reference, is upheld and remains in effect. <br /> SECTION 3. The use permit is conditioned to require further agreement between the <br /> owner and St. Clare's Episcopal Church with respect to joint use of the expanded parking lot <br /> contemplated as part of St. Clare's 2005 Use Permit and Design Review approval for its phased <br /> expansion. <br /> SECTION 4.
