ATTACHMENT 1 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON OF THE <br /> CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING A GROWTH <br /> MANAGEMENT AGREEMENT FOR THE CONSTRUCTION OF ONE NEW SINGLE- <br /> FAMILY RESIDENCE AND RELATED SITE IMPROVEMENTS LOCATED AT 481 <br /> SYCAMORE ROAD, AS FILED UNDER CASE PUD-131 <br /> WHEREAS, on August 2, 2018 Henry Batteate ("Applicant") applied for a PUD <br /> development plan approval under Case No. PUD-131 to construct a new approximately 5,059- <br /> square-foot single-family residence with an approximately 939-square-foot attached garage and <br /> convert the existing 1,016-square-foot residence to an Accessory Dwelling unit ("Project) <br /> located at 481 Sycamore Road ("Property); and <br /> WHEREAS, the Property is designated Low Density Residential in the General Plan; <br /> and <br /> WHEREAS, the Property is located in the North Sycamore Specific Plan area with a land <br /> use designation of PUD-A; and <br /> WHEREAS, on January 18, 2019, the Applicant resubmitted plans including <br /> modifications to the site design to retain additional trees on-site; and <br /> WHEREAS, on February 1, 2019, the application was deemed complete; and <br /> WHEREAS, on March 13, 2019, the Planning Commission, forwarded a <br /> recommendation of approval of the project to the City Council; and <br /> WHEREAS, on April 16, 2019 the City Council, following notification to the public in the <br /> prescribed manner, conducted a public hearing, where the application was on the consent <br /> calendar; and <br /> WHEREAS, the City Council considered the written agenda report, public testimony, <br /> related project materials, and staff recommendations; and <br /> WHEREAS, the proposed project is categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA) pursuant to 15182, Projects Pursuant to a Specific <br /> Plan; and <br /> WHEREAS, after review of the materials presented, the City Council determined that the <br /> PUD plan is consistent with the General Plan, North Sycamore Specific Plan, and purposes of <br /> the PUD ordinance based on the considerations set forth in this ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1: The City Council finds that the project is exempt from further <br /> environmental analysis pursuant to Section 15182 because it is consistent with the North <br /> Sycamore Specific Plan and General Plan, and creates no new impacts. <br />
