D. City Manager Authority. By entering into this Agreement the parties agree that <br /> the City Manager has broad powers to resolve disputes raised in accordance with the provisions <br /> of this Agreement. The City Manager's authority includes, but is not limited to,the power to <br /> encourage the parties to make payments or refunds or credits, to refuse to hear or act upon <br /> complaints that are trivial or can be resolved through other means, or to take other actions in onto <br /> to fairly resolve disputes that arise out of the administration of this Agreement. In addition, the <br /> City Manager is authorized to use a mediator to resolve a dispute,the cost of which will be borne <br /> evenly between the Property Owner and the City. The Property Owner consents to participate in <br /> and pay 50% of the cost for such mediation in the event the City Manager determines mediation <br /> should be utilized. <br /> IV. ADJUSTED MONTHLY RENTS AND RENT INCREASES <br /> A. Adjusted Monthly Rent. Any Resident may request from the Property Owner the <br /> amount of that Resident's Adjusted Monthly Rent. Upon request by the City Manager, the <br /> Property Owner shall provide to the City Manager the amount of the Adjusted Monthly Rent for <br /> each Resident to assure compliance with this Agreement and that Adjusted Monthly Rents are <br /> properly calculated. <br /> B. Annual Increases to Adjusted Monthly Rent. On January 1 of each year, the Owner <br /> may revise the Monthly Rent for Residents as follows: <br /> 1. Residents Prior to January 1, 2002 . The Adjusted Monthly Rent for <br /> Residents who first occupied their spaces prior to January 1, 2002, may be revised by: <br /> a. Multiplying the current Monthly Rent by the Social Security Cost <br /> of Living Adjustment and adding that result to the current Monthly Rent; and <br /> b. Adding any Capital Improvement Costs and Pass Throughs. <br /> 2. Residents After January 1, 2002. The Adjusted Monthly Rent for <br /> Residents who first occupied their spaces after January 1, 2002, may be revised by: <br /> a. Multiplying the current Monthly Rent by the Cost of Living, but <br /> not less than 1.5%nor more than 3.95% and adding that result to the current Monthly Rent; and <br /> b. Adding any Capital Improvement Costs and Pass Throughs. <br /> C. Adjusted Monthly Rent for 2019. Notwithstanding Section B, above,the Monthly <br /> Rent for Residents for the period between March 1, 2019 and December 31, 2019 shall be <br /> established as follows: <br /> 1. Residents Prior to January 1, 2002. The Adjusted Monthly Rent for <br /> Residents who first occupied their spaces prior to January 1, 2002, shall be established by: <br /> a. Multiplying the Monthly Rent that was in effect on December 31, <br /> 2018 by the Social Security Cost of Living Adjustment and adding that result to the Monthly <br /> Rent that was in effect on December 31,2018; and <br /> 021538.0001\5359154.1 4 <br />
