L. "Space Rent" means the consideration, including any bonus, benefits, or gratuity, <br /> demanded or received in connection with the use and occupancy of a mobilehome park or for the <br /> transfer of a lease for park space, services and amenities, subletting and security deposits, but <br /> exclusive of any amounts paid for the use of the mobilehome dwelling unit. <br /> M. "Transfer of ownership" means any voluntary or involuntary sale, assignment or <br /> transfer of ownership of a mobilehome or of any interest in the mobilehome, including, but not <br /> limited to, a fee simple interest, a joint tenancy interest, a life estate, lease or an interest <br /> evidenced by a contract by which possession of the mobilehome is transferred and the remaining <br /> Resident retains title, but excluding transfers by a living trust, lease, gift, devise or inheritance to <br /> an existing spouse, existing domestic partner, or surviving joint tenant, or a spouse or domestic <br /> partner as part of a dissolution proceeding or in connection with entering into marriage or <br /> domestic partnership. <br /> II. MOBILEHOME ORDINANCE <br /> The City has adopted a mobilehome rent stabilization ordinance, codified at Chapter 6.60 <br /> of the Pleasanton Municipal Code ("Mobilehome Ordinance"). The Property Owner who is <br /> signatory to this Agreement and who is operating its Park in compliance with this Agreement <br /> shall be exempted from the Mobilehome Ordinance during the term of this Agreement, except <br /> where this Agreement specifically requires compliance with the Mobilehome Ordinance. Except <br /> as otherwise provided in this Agreement, issues concerning whether the Property Owner is <br /> operating the Park in good faith compliance with this Agreement shall be resolved as provided in <br /> Article III of this Agreement. <br /> III. DISPUTE RESOLUTION PROCESS <br /> A. Initiation of Request. The City Manager may meet on an issue or issues of interest <br /> to a Resident or the Property Owner, including the calculations used for a rent increase. The <br /> request must be in writing but shall not require any particular number of signatures beyond that <br /> of the person making the request. The request must identify the problem(s)to be addressed by <br /> the City Manager and may recommend a solution. <br /> B. Prerequisite to Request. The City Manager may consider a request only after the <br /> following events have occurred: <br /> 1. In the case of a Resident requesting a dispute be resolved,the Resident <br /> making the request has submitted the issue in writing to the Property Owner's representative. In <br /> the case of the Property Owner requesting a dispute be resolved,the Property Owner making the <br /> request has presented the issue to the Residents at an all Park meeting. <br /> 2. A satisfactory resolution of the issue has not been achieved within 30 days <br /> from submittal of the issue under subsection B.1 above. <br /> C. Assistance in Process. The City Manager may select staff members, experts, <br /> professionals,trades people, or other resources he or she deems necessary to assist in reviewing <br /> the request. The City Manager may coordinate efforts towards resolution of disputes with the <br /> California Department of Housing and Community Development's Mobilehome Ombudsman. <br /> 021538.0001\5359154.1 3 <br />
