Administrator explained that State Law requires cities to treat a large family daycare home as a
<br /> residential use and that the scope of a city's review is limited to placing reasonable conditions
<br /> on the project related to spacing and concentration, traffic control, parking, and noise control.
<br /> In response to the concerns raised and to ensure that the proposed large family daycare home
<br /> would be operated in compliance with the State regulations, the Zoning Administrator added a
<br /> condition to require a 30-minute gap be provided between the mid-day drop-off and pick-up
<br /> times. This condition will ensure that there is no possibility of there being more than 14 children
<br /> on-site at any one time. Upon hearing all of the public testimony and reviewing the application,
<br /> the Zoning Administrator found that, as conditioned, the proposed large family daycare home
<br /> met the criteria stated in the Pleasanton Municipal Code. The Zoning Administrator's approval
<br /> letter dated "February 1 , 2019" is attached as Exhibit D.
<br /> On February 15, 2019, Joshua Brysk filed an appeal of the Zoning Administrator's approval.
<br /> Please see Exhibit B. Mr. Brysk's appeal letter states that numerous questions and petitions
<br /> from residents concerning the safety, traffic and noise impacts from the proposed large family
<br /> daycare home to the neighborhood were not considered by the Zoning Administrator. The
<br /> appeal is now before the Planning Commission.
<br /> SITE AND AREA DESCRIPTION
<br /> The subject site is a single-family residential property located at 3149 Chardonnay Drive. The
<br /> lot is approximately 8,125-square-feet in area and is surrounded by similarly-sized
<br /> single-family homes to the east, west, and south. The property abuts Vineyard Avenue on the
<br /> north. The location of the site and the surrounding area are shown in Figure 1 .

<br /> As proposed and conditioned, the large family day care home would operate from 7 a.m. to
<br /> 6 p.m., Monday through Friday with children between the ages of ages 2 1/2 to 12 years old.

<br /> application. Numerous persons attended the hearing with persons speaking in favor of the
<br /> application while others spoke against. (See Exhibit E for meeting minutes.) Neighbors raised
<br /> various concerns, including but not limited to comments regarding a former 'drug house' on
<br /> Chardonnay, a registered sex offender within 3/4 mile of the location, rear fencing at the site,
