THE CITY OF 1 <br /> CITY COUNCIL AGENDA REPORT <br /> pLEASANTON® <br /> March 11 , 2019 <br /> City Attorney <br /> Community Development <br /> TITLE: ADOPT, OR INTRODUCE, AN ORDINANCE AMENDING CHAPTER 18.110 <br /> OF THE PLEASANTON MUNICIPAL CODE (PERSONAL WIRELESS <br /> SERVICE FACILITIES) TO ADD A NEW SECTION 18.110.010B (SPECIAL <br /> PROVISIONS FOR SMALL WIRELESS FACILITIES); ADOPT A <br /> RESOLUTION APPROVING A NEW COUNCIL POLICY (SMALL WIRELESS <br /> FACILITIES) FOR THE PURPOSE OF REGULATING THE PERMITTING, <br /> DESIGN, AND LOCATION OF SUCH FACILITIES CITYWIDE; AND <br /> APPROVE THE USE OF A POLE LICENSE AGREEMENT <br /> SUMMARY <br /> In order to comply with recent changes in federal and state law that affect local authority <br /> over small wireless facilities, the City Council is asked to amend the City's wireless <br /> ordinance and approve a policy to regulate the permitting, design, and location of small <br /> wireless facilities on City-owned light poles and similar infrastructure. <br /> RECOMMENDATION <br /> It is recommended that the City Council review and approve: 1) an urgency ordinance to <br /> amend PMC 18.110.010(B) (or alternatively approve an introduction of said ordinance <br /> on March 11 with a second reading on March 19, 2019); 2) adopt a resolution approving <br /> a new Council Policy for the purpose of regulating the permitting, design, and location of <br /> small wireless facilities; and 3) approve the use of a Pole License Agreement between <br /> the City and small wireless providers. <br /> FINANCIAL STATEMENT <br /> There is minimal financial impact. Pursuant to Federal Communications Commission's <br /> (FCC) action on December 10, 2018, small wireless providers are required to pay an <br /> annual license fee of $270 per site for use of the City's infrastructure. <br />
