AB 2797 (Bloom) Planning and Zoning. Density Bonuses. <br /> Chapter 904, Statutes of 2018 <br /> This measure requires any density bonus, concessions, incentives, waivers, or <br /> reductions of development standards, and parking ratios to which the applicant is <br /> entitled to under the statutes related to density bonuses to be permitted in a manner <br /> that is consistent with Density Bonus Law and the California Coastal Act of 1976. This <br /> measure also contains uncodified language that states that it is the intent of Legislature <br /> in amending subdivision (m) of Section 65915 of the Government Code to supersede <br /> the holding and dicta in Kalnel Gardens, LLC v. City of Los Angeles that Section 65915 <br /> is subordinate to the California Coastal Act of 1976 (Public Resources Code Division 20 <br /> (commencing with Section 30000)). The Legislature's intent is that the two statutes be <br /> harmonized. <br /> AB 2913 (Wood) Building Standards. Building Permits Expiration. <br /> Chapter 655, Statutes of 2018 <br /> This measure requires a building permit to be valid for 12 months if work authorized by <br /> the permit has not commenced from the date a permit is issued, unless the permittee <br /> requests an extension; authorizes a local building official to grant one or more <br /> extensions of up to 180 days each, provided the extension is requested in writing and <br /> demonstrates justifiable cause; and provides that a local ordinance adding or modifying <br /> building standards for residential occupancies do not apply to a permit that is <br /> subsequently deemed expired because construction has not commenced within 12 <br /> months of the date of issuance or the permittee has abandoned the work authorized by <br /> the permit. <br /> AB 2923 (Chiu) San Francisco Bay Area Rapid Transit District. Transit-Oriented <br /> Development. <br /> Chapter 1000, Statutes of 2018 <br /> This measure gives the San Francisco Bay Area Rapid Transit (BART) land use <br /> authority over BART owned land within one-half mile of an existing or planned BART <br /> station. Where local zoning is inconsistent with the BART Transit Oriented <br /> Development (TOD) zoning standards for a station, this measure requires the local <br /> jurisdiction to adopt a local zoning ordinance that conforms to the BART TOD zoning <br /> standards within two years of the date that the BART TOD zoning standards are <br /> adopted by the board for a station, or by July 1, 2022, if the board has not adopted TOD <br /> zoning standards for the station. This measure will sunset on January 1 , 2029. <br /> SB 828 (Wiener) Land Use. Housing Element. <br /> Chapter 974, Statutes of 2018 <br /> This measure makes numerous changes to the RHNA process. These changes include: <br /> • Modifying existing codified intent language to remove the acknowledgement that <br /> cities may not meet RHNA; and <br /> • Altering the methodology to account for overcrowding; jobs/housing imbalance; <br /> and "cost burdened." <br /> SB 946 (Lara) Sidewalk Vendors. <br /> 9 <br />
