Funding. State-Assisted Projects. <br /> Chapter 800, Statutes of 2018 <br /> This measure prohibits cities and counties from requiring a letter of acknowledgment or <br /> similar document prior to applying for state assistance for any housing development. <br /> State assistance includes, any state funds, a state tax credit, or a federal tax credit <br /> administered by the state. <br /> AB 3194 (Daly) Housing Accountability Act. Project Approval. <br /> Chapter 243, Statutes of 2018 <br /> This measure makes two important changes to the Housing Accountability Act. These <br /> changes are as follows: <br /> • Provides that a proposed project is not inconsistent with applicable zoning <br /> standards and criteria, and shall not require a rezoning, if the proposed project is <br /> consistent with objective general plan standards and criteria but the local <br /> agency's adopted zoning for the project site is inconsistent with the general plan; <br /> and <br /> • Allows a local agency to require a proposed project to comply with objective <br /> standards and criteria of the zoning consistent with the general plan, but requires <br /> the standards and criteria to be applied to facilitate and accommodate <br /> development at the density allowed on the site by the general plan and proposed <br /> by the project. Requires the local agency to provide the applicant with written <br /> documentation identifying the provision or provisions that are not in compliance, <br /> and explaining the reasons why, pursuant to existing law. <br /> SB 1115 (Hill) Property Taxation. Welfare Exemption. Low Income Housing. <br /> Chapter 694, Statutes of 2018 <br /> This measure increases the cap from $10 to $20 million on the existing property tax <br /> exemption for non-public financed rental housing properties owned by a non-profit <br /> corporation where 90 percent of the residents are low income. <br /> Land Use/Planning (2018) <br /> AB 626 (E. Microenterprise Home Kitchen <br /> Operations. <br /> Chapter 470, Statutes of 2018 <br /> This measure establishes "microenterprise home kitchens" (MHKs) as a new category <br /> of retail food facility, that cities or counties would have discretion to authorize and <br /> permit, to be operated by a resident in a private home, subject to specified <br /> requirements.
