Box 520 <br /> Pleasanton, CA 94566 <br /> CITY kiANAOFR <br /> To Pleasanton City Council, <br /> We wanted to contact you in regards to the current use dispute between the Chabad Center, <br /> located at 3370 Hopyard Road, and Millers of Bryce Canyon Court, in Pleasanton. While this <br /> dispute has been contentious, we are encouraged the two parties appear to have reached a <br /> settlement. However,before the City Manager makes a recommendation for the Council to <br /> approve, we ask the Planning Commission to consider the existing Parking Lot Use Agreement <br /> between St. Clare's Episcopal Church and Chabad, as we believe the proposal, given at the <br /> recent Pleasanton City Council meeting, ignored the existing and approved agreement. <br /> For over the past year, St. Clare's has been working with Chabad on joint parking lot terms to <br /> allow Chabad to receive its initial Conditional Use Permit. The joint agreement was submitted <br /> and approved by the city. The proposed agreement between the Chabad and the residents of <br /> Bryce Canyon does not take into account this existing agreement and has a direct impact on <br /> parking and traffic flow on St. Clare's Church. It is therefore time that we address some issues <br /> we see with all the proposals and plans as they were presented at the recent meeting. <br /> 1. Our parking lot agreement is for 50 years and includes a plan for an expansion of the <br /> parking lot on the west side of Chabad's building,opposite of Hopyard Road. This was <br /> presented to the city's Planning Department and approved. Over the past few meetings, <br /> there have been alternate plans for the layout of Chabad's expansion, one of those,which <br /> you approved, included building a play yard and terrace on that side of the building,the <br /> same side the parking lot expansion was to go. This creates a conflict with this existing <br /> agreement. <br /> 2. The only physical entrance to Chabad's property is through the joint parking lot, an area <br /> about 20 feet wide,directly where the proposed playground and terrace are to be built. <br /> This then precludes Chabad from having my access to their property for vehicle access. <br /> At the August 21 meeting, it was mentioned about a proposed house being built behind <br /> the present building. However, there is no easement suggested for that residence,and the <br /> plan, as presented,would not provide access.
