BACKGROUND <br /> Original PUD Application <br /> On July 24, 1985, the Planning Commission recommended the approval of PUD-85-09, <br /> a Planned Unit Development (PUD) application by GEF Financial Corporation, to <br /> construct a two- and three-story, 132-unit retirement facility on an approximately 2.5- <br /> acre site located at 5700 Pleasant Hill Road. <br /> On September 3, 1985, the City Council approved PUD-85-09 by adopting Ordinance <br /> No. 1214. The approval of the PUD did not include an expiration date; accordingly, <br /> construction plans in substantial conformance with the PUD-85-09 would require no <br /> additional discretionary review prior to issuing a building permit. <br /> In 2000, Willow Partners (successor to GEF Financial Corporation) submitted <br /> construction plans to construct the approved retirement facility. Subsequently, Willow <br /> Partners abandoned the project prior to the issuance of a building permit. <br /> In 2007, Sunrise Senior Living (Sunrise; successor to Willow Partners) purchased the <br /> property and proposed a redesign (PUD-85-09-1 M), which provided for a three-story <br /> facility with underground parking. Following a May 7, 2007 neighborhood meeting, <br /> Sunrise withdrew its application for a redesign. <br /> In June 2008, Sunrise submitted a "Refined Submittal" (revised plans). As provided for <br /> in the Municipal Code, the Director of Planning and Community Development, acting as <br /> the Zoning Administrator, determined that the plans were in substantial conformance <br /> with PUD-85-09. Due to the level of neighborhood interest and concerns about the <br /> project, and in recognition of the certainty that the Zoning Administrator's decision would <br /> have been appealed to the Planning Commission, staff placed this matter on the <br /> Planning Commission's agenda. <br /> On June 11, 2008, the Planning Commission reviewed Sunrise's "Refined Submittal," <br /> considered the Zoning Administrator's determination that the project was in substantial <br /> conformance with PUD 85-09 and passed a motion recommending a facilitation process <br /> between Sunrise and select neighbors (chosen by the neighborhood) to determine if <br /> there was a senior living project with design and operational components acceptable to <br /> all parties. Subsequently, three facilitation meetings were held and draft revisions made <br /> to the plans. <br /> On December 10, 2008, the Planning Commission adopted Resolution No. PC-2008-61 <br /> that: <br /> • Determined that the Refined Submittal was in substantial conformance with PUD <br /> 85-09; and <br /> • Confirmed the Zoning Administrator's determination that the Refined Submittal <br /> substantially conformed with PUD 85-09; and <br /> • Authorized the Zoning Administrator to issue a Zoning Certificate. <br /> Page 2 of 3 <br />
