BACKGROUND <br /> ESSEX I —4863 Willow Road <br /> On May 1, 2012, the City Council adopted Ordinance No. 2035, approving PUD-85-08- <br /> 12D that provided for the construction of Essex I, a mixed-use high-density <br /> residential/commercial development consisting of 251 residential units, four live/work <br /> units and approximately 5,700 square feet of retail space on the property located at <br /> 4863 Willow Road. <br /> PUD-85-08-12D, Condition of Approval No. 72, provided that portions of the existing <br /> street right-of-way and public service easements (PSE) along Owens Drive and Willow <br /> Road would be vacated, and new PSEs would be granted to the City. Additionally, PUD- <br /> 85-08-12D provided for a reduction of lanes and the addition of a bike lane along the <br /> project frontage on northbound Willow Road (COA No. 75). It also provided for a <br /> reduction of lanes, the addition of a bike lane and street parking on eastbound Owens <br /> Drive (COA No. 82). The vacation of the street right-of-way provided adequate land for <br /> the construction of a bike lane and a "bulb-out" on northbound Willow Road, as well as <br /> the bike lane and street parking on eastbound Owens Drive. <br /> ESSEX II — 5789 Gibraltar Drive <br /> On May 1, 2012, the City Council adopted Ordinance No. 2036, approving PUD-81-30- <br /> 86D that provided for the construction of Essex II, a mixed-use, high-density <br /> residential/commercial development consisting of 247 residential units, four live/work <br /> units, and a 0.55-acre public park located at 5789 Gibraltar Drive (northern corner of <br /> Gibraltar Drive and Hacienda Drive). <br /> PUD-81-30-86D, Condition of Approval No. 57, provided that portions of the existing <br /> street right-of-way and PSE along Gibraltar Drive would be vacated, and a new PSE <br /> would be granted to the City. Additionally, PUD-81-30-86D, Condition of Approval No. <br /> 75, provided for a reduction of lanes and the addition of a bike lane and street parking <br /> along the project frontage on eastbound Gibraltar Drive. The vacation of street right-of- <br /> way provided adequate land for the construction of a bike lane and street parking. <br /> Summary Vacation of Excess Right-of-Way and Public Service Easements <br /> On May 17, 2016, the City Council adopted Resolution No. 16-860, ordering the <br /> summary vacation of excess right-of-way and public service easements as indicated <br /> below: <br /> • ESSEX I - Owens Drive and Willow Road, and approving the grant of said <br /> excess property to the property owners at 4863 Willow Road; and <br /> • ESSEX II - Gibraltar Drive, and approving the grant of such excess property to <br /> the property owners at 5789 Gibraltar Drive. <br /> All off-site and on-site improvements have been constructed and the public <br /> improvements are ready for acceptance. <br /> Page 2 of 4 <br />
