• The private street (Barias Place) and the following improvements located within <br /> the private street: sanitary sewer laterals, storm drain systems, street lights, <br /> landscaping and irrigation, and related improvements; and <br /> • Bioswales located on each of the 13 new lots and within the parking island <br /> located within the private street. <br /> Partial Release of Improvement Security <br /> Section 66499.7 "Manner of release of security" of the Subdivision Map Act (Map Act) <br /> provides the process by which a developer may request, and how a legislative body <br /> may provide, the partial release of improvement security. <br /> Pursuant to the Map Act, Kontech informed staff on May 3, 2018, that all public and <br /> private improvements were completed and requested a release of 90 percent of the <br /> improvement security, which they provided in the form of a cash deposit. Staff has <br /> inspected the work and concurs that approximately 90 percent of the improvements are <br /> complete and ready for acceptance. The remaining work cannot be completed until the <br /> two remaining homes (Lots 1 and 2) are completed as a matter of construction <br /> sequencing. Lots 1 and 2 are currently under construction. <br /> If the City Council accepts 90 percent of the public improvements, 90 percent <br /> ($672,570) of the $747,300 cash deposit provided by Kontech as improvement security <br /> will be released.
