BACKGROUND <br /> On July 13, 2011 , the Planning Commission recommended City Council approval of <br /> PUD-82, a Planned Unit Development (PUD) application by DiDonato Builders, Inc. to <br /> construct 13 single-family homes located at an approximately 1.2-acre site at 4171 and <br /> 4189 Old Stanley Boulevard. Subsequently, on October 18, 2011, the City Council <br /> approved PUD-82 and adopted Ordinance No. 2021. <br /> On July 11 , 2012, the Planning Commission approved an application by DiDonato <br /> Builders, Inc. for Vesting Tentative Map 7968 to subdivide an approximately 1.2-acre <br /> site, located at 4171 and 4189 Old Stanley Boulevard, into 13 single-family home lots <br /> consistent with the PUD development plan for this site. <br /> In January of 2013, Kontech USA, Inc. (Kontech) purchased the site from DiDonato <br /> Builders, Inc. <br /> On May 3, 2016, the City Council approved the final map, improvement plans and <br /> subdivision agreement for Tract 7968. <br /> In May 2018, Kontech informed staff that all public and private improvements were <br /> completed and requested a release of 90 percent of the improvement security, which <br /> they provided in the form of a cash deposit. Staff inspected the work and determined <br /> that approximately 90 percent of the improvements are complete and ready for <br /> acceptance. <br /> DISCUSSION <br /> Construction of Subdivision Improvements <br /> The subdivision agreement provides for the construction of public utilities within the <br /> private street and Old Stanley Boulevard to serve the 13 new lots. <br /> Public Improvements <br /> The public subdivision improvements serving the 13 new lots that will be operated and <br /> maintained by the City include: <br /> • A public sanitary sewer main, public water main, and one public fire hydrant <br /> located within dedicated public easements and within the private street (Barias <br /> Place); and <br /> • A public sanitary sewer main and public water main on Old Stanley Boulevard; <br /> and <br /> • Curb, gutter, sidewalk, 85 linear feet of 12-inch diameter storm drain and a <br /> concrete valley gutter within the public right-of-way along the project's Old <br /> Stanley Boulevard frontage. <br /> Private Improvements <br /> The private subdivision improvements serving the 13 new lots that will be operated and <br /> maintained by the homeowners association as provided for in the Declaration of <br /> Covenants, Conditions, and Restrictions of Old Stanley Boulevard (CC&Rs), which was <br /> recorded on June 23, 2016, include: <br /> Page 2 of 3 <br />
