BACKGROUND <br /> Original PUD Application <br /> On June 19, 2001, City Council approved PUD-5, an application by Centex Homes to <br /> subdivide two parcels located at 1944 and 2190 Vineyard Avenue into 19 lots for new <br /> single-family detached homes. The application provided for: <br /> • Nine lots for 2190 Vineyard Avenue (Berlogar property) and one lot for the <br /> existing Berlogar residence; and <br /> • 10 lots for 1944 Vineyard Avenue (Chrisman Property) and one lot for the <br /> existing Chrisman residence. <br /> On July 19, 2003, the Planning Commission denied an application by Northstar <br /> Construction and Development (successor to Centex Homes) for Vesting Tentative Map <br /> 7399, to subdivide the property into 19 lots for single-family homes in accordance with <br /> the PUD plans. On August 19, 2003, the City Council approved Northstar's appeal of <br /> Tract 7399. <br /> City Council Approval for Two Phases <br /> On October 4, 2005, the City Council approved PUD-05-01 M for a major modification to <br /> the approved PUD-5 to bifurcate the development into two phases (Berlogar and <br /> Chrisman) and replace the approved house design plans. <br /> First Phase —Tract 7399 <br /> The first phase, Tract 7399 (Silver Oaks Estates) which created nine new lots and a <br /> public street (Silver Oaks Lane) has been constructed by Frank Berlogar. On August 19, <br /> 2008, the City Council accepted public improvements associated with Tract 7399. <br /> Second Phase — Tract 7660 <br /> On June 18, 2014, City staff, acting under their authority, approved PUD-05-07M (a <br /> minor modification) for Planned Unit Development modifications governing the second <br /> phase (Chrisman) of PUD-05-01 M. The minor modification provided for: <br /> • Construction of production homes; and <br /> • Modification to the site grading; and <br /> • Relocation of Lots 6-10 to the east to allow the Chrisman private driveway to be <br /> installed on Chrisman Property; and <br /> • Elimination of the emergency vehicle access road to the Berlogar Property (88 <br /> Silver Oaks Court); and <br /> • Installation of a new water well for the common space landscaping and <br /> agricultural operations on the remaining Chrisman property; and <br /> • Modification to the timing for the installation of landscaping in the common open <br /> space area. <br /> On June 2, 2015, the City Council approved the Final Map, Improvement Plans, and <br /> "Agreement for Final Map Approval Without Improvement Agreement or Bonds" with the <br /> Chrisman Family Trust and KC Bello LLC (successor to Northstar) for Tract 7660. This <br /> agreement allowed the Final Map to be recorded which divided the Chrisman home <br /> property from the development area and creating the 10 lots that were to be sold to the <br /> developer. The developer was then to enter into the Subdivision Improvement <br /> Agreement and supply the necessary bonds. <br /> Page 2 of 4 <br />
