BACKGROUND <br /> On March 23, 2016, the Planning Commission recommended approval of PUD-99, a <br /> Planned Unit Development (PUD) application by Ponderosa to construct 19 single- <br /> family home lots located on an approximately 9-acre site at 1851 Rose Avenue. <br /> On May 3, 2016, the City Council approved PUD-99 by adopting Ordinance No. 2142. <br /> On May 25, 2016, the Planning Commission approved an application by Ponderosa for <br /> Vesting Tentative Map 8317, which conformed with PUD-99. <br /> On August 15, 2017, the City Council approved the Final Map, On-Site Improvement <br /> Plans, Off-Site Improvement Plans, Subdivision Agreement, Off-Site Improvement <br /> Agreement, and Reimbursement Agreement (see Attachment 2) for Tract 8317. <br /> Background for the Reimbursement Agreement <br /> The 1996 General Plan provided for the westward extension of Rose Avenue to Valley <br /> Avenue through Alameda County Fairgrounds' and Zone 7 properties, which also <br /> included the extension of public sanitary sewer and water mains. <br /> Following City Council adoption of the 1996 General Plan, the following development <br /> projects along Rose Avenue constructed sanitary sewer and water mains on Rose <br /> Avenue as part of the future extension of those utilities to Valley Avenue: <br /> • Tract 7002 <br /> • Tract 7143 <br /> • Tract 7534 <br /> The Tract 7143 developer, SummerHill Rose Ltd. (SummerHill), entered into a deferred <br /> improvement agreement (see Attachment 3) on July 25, 2000 that provided for: <br /> • Payment of their pro-rata share for the public sanitary sewer and water main <br /> extension costs associated with Tract 7143; and <br /> • A surety bond guaranteeing they would acquire public service easements for the <br /> public sanitary sewer and water main extension on Alameda County <br /> Fairgrounds' property. <br /> On July 26, 2000, SummerHill paid their pro-rata share of $70,128.00 and posted a <br /> surety bond with the City in an amount of $60,000. <br /> Additionally, the developers of Tract 7002, Tract 7534, Tract 8139 and Parcel Map <br /> 10537, paid their pro-rata share for the sanitary sewer and water extension to Valley <br /> Avenue. The paid amounts and present values (including interest) of the developers' <br /> pro-rata shares are shown below in Table 1. <br /> Page 2 of 4 <br />
