five Lighting and Landscape Maintenance Districts (Districts). These parcels contain <br /> various City utilities such as water tanks, sewer lift stations and water pump stations. <br /> The City will pay approximately $17 for the parcel in District 1984-1, $253 for the parcel <br /> in District 1993-2, $466 for the parcel in District 1994-1 and $1,121 for the two parcels in <br /> District 1995-1. Staff recommends appropriating $10,746 from the General Fund for the <br /> parcels including the Arroyo de la Laguna, the park parcel in District 1984-1 , the sewer <br /> lift station parcel in District 1994-1 , and the staging area in District 1995-1; and <br /> appropriating $814 from the Water Operating Fund for the water tank in District 1993-2 <br /> and the water tank in District 1995-1. It is the City's intention to continue administering <br /> contracts with private contractors for the maintenance of these districts. <br /> A loan is also required to cover the projected funding shortfalls of two of the Districts. <br /> District 1993-1 (Windsor) requires a loan of $5,375.10 and District 1993-2 (Bonde <br /> Ranch) requires a loan of $9,680.27. <br /> The fiscal impact to the City is subject to change based on the analysis of the consultant <br /> when they review the Districts for conformance with Proposition 218 and to determine a <br /> recommended assessment for the parcels within each District. <br /> There is minimal fiscal impact to the City relating to the administration of the Districts. As <br /> part of the assessment, the City collects an annual fee to administer the Districts and <br /> maintenance contracts. A portion of this fee, along with interest earnings and <br /> delinquency penalties, is available to reimburse the City for a portion of staff time. <br /> BACKGROUND <br /> The Landscaping and Lighting Act of 1972 authorizes local agencies to impose an <br /> annual assessment on real property benefiting from improvements in order to pay for <br /> constructing and maintaining lighting and landscaping improvements. The assessments <br /> are collected by Alameda County as part of the annual tax bill. <br /> At the meeting on May 15, 2018, City Council approved the Engineer's Report relating to <br /> each respective assessment district and scheduled the June 19, 2018 public hearing in <br /> conformance with the requirements of the State of California Landscaping and Lighting <br /> Act of 1972. <br /> DISCUSSION <br /> As required by the Landscaping and Lighting Act of 1972, the City must levy an annual <br /> assessment to all parcels benefited by their District. The resolutions adopted at the <br /> meeting on May 15, 2018, authorized the City Clerk to give the required notice of public <br /> hearing regarding the levy of proposed annual assessments for the respective Districts. <br /> At the meeting on June 19, 2018, the City Council will hear and consider all public <br /> comments, and make modifications, if determined to be necessary, to the proposed <br /> assessments. After the close of the public hearing, the Council will, if desired, adopt a <br /> resolution confirming the Engineer's Report and levying assessments for each of the <br /> Districts for fiscal year 2018-19. <br /> Page 2 of 5 <br />
