Ordinance No. 2179 <br /> Page 16 of 16 <br /> until the application is approved, conditionally approved, or denied, whichever occurs <br /> first. <br /> If the planning commission denies a subdivider's application for extension, the <br /> subdivider may appeal to the city council within 15 days after the planning commission <br /> has denied the extension. <br /> 19.22.070 Term and expiration of development rights. <br /> A. The expiration of a vesting tentative map shall be as set forth in Section 19.20.130, <br /> and the process for the application for an extension shall be as set forth in Section <br /> 19.20.140. <br /> B. Duration of Development Rights. The right to proceed with development as set forth <br /> in Section 19.22.050 continues for one year following the recordation of the final map or <br /> parcel map. If a project covered by a single vesting tentative map is divided into phases <br /> and more than one final map is recorded, the one-year period begins for each phase <br /> when the final map for that phase is recorded. <br /> C. Expiration of Development Rights. <br /> 1 . The right to proceed with development as set forth in subsection B of this <br /> section shall expire if a final map is not approved before the vesting tentative map <br /> expires. <br /> 2. If the subdivider or a successor submits a complete application for a building <br /> permit during the one-year period specified in subsection C, the right to proceed with <br /> development continues until that permit or any extension of that permit granted by the <br /> city expires. <br /> D. Extension of Time for Exercise of Development Rights. <br /> 1. If the city does not process an application for a grading permit or for design <br /> review within 30 days of the date the application is complete the one-year period <br /> specified in subsection C of this section is automatically extended by the time exceeding <br /> the 30-day period used by the city to complete processing. <br /> 2. Before the expiration of the one-year period specified in subsection C of this <br /> section, the subdivider or successor may apply to the city council for a one-year <br /> extension. <br />
