Councilmember Narum thanked all participants in the public hearing. She agreed with <br /> Councilmember Pentin's comments regarding the difficulty of making decisions which involve <br /> disparity between various resident preferences. She noted this is a one-year contract, with options <br /> to extend, and not a long-term commitment. She supported staff's recommendation and stated <br /> her preference that staff work with PCRT to explore rental opportunities at the Firehouse venue. <br /> Councilmember Olson expressed his support for staff's recommendation and noted his decision is <br /> based upon the importance of"community" and "budget" at this time. <br /> Mayor Thorne inquired why the venue is limited to three shows per year and whether a third show <br /> can be coordinated with PCRT. <br /> City Manager Fialho stated he will follow up with both theatre companies relative to guidelines and <br /> policies for the contract and other rental opportunities at the Firehouse. <br /> MOTION: It was m/s by Brown/Olson to approve and authorize the City Manager to execute an <br /> agreement with Tri-Valley Repertory Theatre for theatrical production services for Civic Arts <br /> Presents not to exceed $130,000 annually. Moved from the Consent Calendar — Introduce an ordinance to amend Pleasanton Municipal <br /> Code Chapter 9.04 Noise Regulations to delete Section 9.04.045 Leaf blowers, thereby subjecting <br /> leaf blowers to general noise time restrictions and decibel limits <br /> Director of Community Development Gerry Beaudin presented the report which includes <br /> amendments to the City's Noise Ordinance as a response to community complaints regarding <br /> leaf-blowers. Currently, the complaints received are not violations of the Municipal Code, which <br /> allows operation of leaf-blowers at 73 decibels from 6:00 a.m. to 10:00 p.m. in residential zones. <br /> The Noise Ordinance restricts noise to 70 decibels, and the proposed Ordinance will create <br /> uniformity to the code by deleting the current leaf-blower section, and restrict hours of operation to <br /> 8:00 a.m. to 8:00 p.m. Monday through Saturday, and 10:00 a.m. to 6:00 p.m. Sundays and <br /> holidays. Leaf-blower users will have to comply with the general 70 decibel noise limits after the <br /> ordinance is amended. <br /> Mayor Thorne described the significant decrease in sound with only a 3 decibel change. Director <br /> Beaudin provided examples of various decibel levels, noting a vacuum cleaner is approximately <br /> 70 decibels and standing next to an operating garbage disposal can register at 80 decibels. <br /> Councilmember Brown acknowledged this matter was a response to complaints regarding quality <br /> of life, which has been impacted by leaf-blower noise. She inquired whether the decibel level is <br /> registered at the fence line or at the site. Director Beaudin responded the levels were different per <br /> district and for residential, it would be registered at any point outside of the property plane (vertical <br /> dimension of the property line). He also confirmed City staff will contact business license holders, <br /> local contractors, and the local business associations to inform them of the changes and for <br /> enforcement. <br /> Councilmember Narum inquired regarding enforcement of the new regulations. Director Beaudin <br /> responded the regulations were adjusted based upon repeated complaints regarding noise and <br /> staff has a plan to respond to "habitual offenders" and also approach business owners holding <br /> licenses with the City. <br /> City Council Minutes Page 11 of 12 March 20, 2018 <br />
