ATTACHMENT 1 <br /> DESIGN PROFESSIONAL SERVICES AGREEMENT <br /> THIS DESIGN PROFESSIONAL SERVICES AGREEMENT ("Agreement") is entered <br /> into this eighth day of March, 2018, between the City of Pleasanton, a municipal corporation <br /> ("City"), and Independent Code Consultants, Inc., whose address is 1931 San Miguel Drive, <br /> Suite 100, Walnut Creek, CA 94596, and telephone number is (925) 433-1991, ("Consultant"). <br /> RECITALS <br /> A. Consultant is qualified and experienced in providing plan review, permit counter and <br /> inspection services for the purposes specified in this Agreement. <br /> B. City finds it necessary and advisable to use the services of Consultant for the purposes <br /> provided in this Agreement. <br /> NOW, THEREFORE, in consideration of the mutual covenants and conditions in this <br /> Agreement, City and Consultant agree as follows: <br /> 1. Consultant's Services. Consultant shall provide plan review, permit counter and <br /> inspection services for the City of Pleasanton as requested by the Community Development <br /> Department, pursuant to individual Work Authorizations. This Agreement does not obligate the <br /> City to utilize Consultant exclusively for these services, and the City reserves the right to select <br /> other consultants for these services based on City need. City guarantees no level of work to be <br /> directed. <br /> 2. City Assistance. Except as set forth in Exhibit A, Consultant shall, at its sole cost and <br /> expense, furnish all facilities and equipment that may be required for furnishing services <br /> pursuant to this Agreement. In order to assist Consultant in this work, City shall provide, if <br /> necessary only the facilities and equipment listed in Exhibit A according to the terms and <br /> conditions set forth in Exhibit A. <br /> 3. Staff. Consultant shall assign Abigail Obligacion to serve as coordinator, who may <br /> not be replaced without written consent of City. <br /> 4. Term. Consultant shall begin work on March 8, 2018. The work as described in <br /> Exhibit A, Scope of Work, shall be completed by June 30, 2020. The City, at its discretion, may <br /> extend the agreement for up to two additional one-year terms at the same terms and conditions <br /> contained within this Agreement. <br /> 5. Compensation. For the services to be rendered, City shall pay Consultant for services <br /> rendered pursuant to this agreement, as described more particularly in Exhibit A, which is <br /> attached and incorporated to the extent consistent with this Agreement. Payment shall be made <br /> on a monthly basis upon receipt and approval of Consultant's invoice. Total compensation for <br /> services and reimbursement for costs shall not exceed $60,000 through the remainder of this <br /> Page 1 of 10 <br />
