RESOLUTION NO. 17-984 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A PREANNEXATION AGREEMENT FOR WATER AND SANITARY <br /> SEWER CONNECTIONS FOR 622 HAPPY VALLEY ROAD (KULDEEP SINGH/BAP <br /> PROPERTIES LLC) AND AUTHORIZING AN APPLICATION TO THE LOCAL <br /> AGENCY FORMATION COMMISSION FOR OUT-OF-AREA SERVICES <br /> WHEREAS, at the meeting of December 19, 2017, the City Council received a <br /> report from the Director of Community Development regarding the request from Kuldeep <br /> Singh/BAP Properties LLC for water and sanitary sewer connections for the property <br /> located at 622 Happy Valley Road, in unincorporated Alameda County, to construct <br /> one new single-family residence; and <br /> WHEREAS, Government Code Section 56133 requires a city that wishes to <br /> provide utility services beyond its jurisdictional boundary to obtain approval from the <br /> Local Agency Formation Commission (LAFCo); and <br /> WHEREAS, the City Council adopted Resolution No.17-961 allowing owners of <br /> property within 'the unincorporated Happy Valley to apply for City water and/or City <br /> sanitary sewer services, which applications will be considered on a case-by-case basis <br /> using specified criteria; and <br /> WHEREAS, the present request meets the criteria for preannexation as the: <br /> owner agrees to: a) pay water and/ or sanitary sewer connection fees; b) pay all costs <br /> associated with making physical connections to City water service and/or City sanitary <br /> sewer service in a manner consistent with City standards in the determination of the <br /> City Engineer or his or her designee; c) abandon any septic system on the property if <br /> connecting to City sanitary sewer service; d) pay pro-rata share of previously <br /> constructed City water and/ or City sanitary sewer infrastructure in Happy Valley; e) pay <br /> pro-rata share of future frontage improvements along the property if the County or City <br /> in the future undertake public street frontage improvements including, but not limited to, <br /> curb, gutter/storm drain system, sidewalk, street lights, etc.; f) pay all City and County <br /> processing fees for Alameda County Local Agency Formation Commission (LAFCo) and <br /> Livermore-Amador Valley Water Management Agency (LAVWMA) approval; g) obtain <br /> City design review approval for a future residence and any future addition or alteration <br /> to the property requiring a building permit from the County; h) agree to not subdivide the <br /> site; i) support any subsequent annexation initiative that may occur; and j) execute and <br /> record against the property a Preannexation Agreement setting forth these terms. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br />
