EXHIBIT A <br />CONDITIONS OF APPROVAL <br />PCUP-248, Kevin Butler <br />1040 Serpentine Lane <br />September 9, 2009 <br />The location and operation of the proposed use shall conform substantially to <br />Exhibit B (site plan, floor plan, and project narrative), dated "Received, July 27, <br />2009," and project narrative, dated August 8, 2009, on file with the Planning <br />Division, except as modified by the following conditions of approval. Minor <br />changes to the approved operation and schedule may be. approved by the <br />Director of Community Development if found to be in substantial compliance with <br />the proposal. <br />2. All Conditions of Approval of PUD -80-1 shall remain in full force and effect. <br />3. Prior to issuance of business license, the applicant shall provide the City a letter <br />confirming that a lease for either Suite 203 or Suite 209 has been signed. This <br />Conditional Use Permit shall be effective only when a lease is signed and it will <br />otherwise expire. <br />4. If Suite 203 is chosen and a business license is approved, the existing <br />conditional use permit for Gorman Roofing Services shall expire immediately. <br />Prior to issuance of business license for Suite 203, the property owner shall <br />provide a letter providing acknowledgment of this condition. <br />5. Prior to issuance of a business license, the applicant shall contact the Building <br />and Safety Division and the Fire Marshall to ensure that the proposed use of the <br />tenant space meets Building and Fire Code requirements. If required, the <br />applicant shall obtain all appropriate City permits. <br />6. Upon submittal of business license, the applicant shall select either Suite 203 or <br />209 in the subject building and this Conditional Use Permit approval shall be <br />valid only for the selected suite. If a recreational facility or other conditionally <br />permitted use would like to locate in the suite that is not chosen by the applicant, <br />a new Conditional Use Permit shall be required. <br />7. More than six children who are younger than six years old at the facility at any <br />one time may require interior improvements stipulated by Building Code. <br />8. All activities shall take place inside of the subject facility. <br />
