PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-28 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR <br />SNAP FITNESS, AS FILED UNDER CASE PCUP-247 <br />WHEREAS, Snap Fitness has applied for a Conditional Use Permit to operate a fitness <br />facility at 6654 Koll Center Parkway, Suite 355; and <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development — <br />Industrial/Commercial-Office) District; and <br />WHEREAS, at its duly noticed public hearing of September 9, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, this project is categorically exempt from environmental review pursuant to <br />California Environmental Quality Act (CEQA) Guidelines, Section 15301, <br />Existing Facilities, Class 1; and <br />WHEREAS, the Planning Commission made the following findings: <br />1. The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />The City has allowed similar, yet larger, uses to be located in office, industrial, and <br />commercial areas, e.g., 24 -Hour Fitness in Hacienda Business Park. Small-scale <br />fitness facilities, such as Curves and Anytime Fitness, have not created any impacts on <br />surrounding businesses in their respective zoning districts. <br />As conditioned, Snap Fitness would operate consistent with the Planned Unit <br />Development guidelines for Bernal Plaza, zoning district criteria, and the General Plan <br />land use designation. Therefore, this finding can be made. <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />The use of the facility will be restricted to indoor use, and all doors would remain closed. <br />As conditioned, the fitness center would not be detrimental to the public health, safety, <br />or welfare, or materially injurious to properties or improvements in the vicinity. Any <br />proposed modifications related to the operations would need to be reviewed and <br />approved by the Director of Community Development. The proposed use would not <br />detrimentally impact the surrounding properties, and, therefore, this finding can be <br />made. <br />
