NPDES Permit minimum requirements including adequate <br />maintenance and that the vertical distance from the base of any <br />infiltration device to the seasonal high groundwater mark shall be at <br />least 10 feet. <br />Each individual developer shall be responsible for implementation and <br />maintenance of BMPs. A BMP Monitoring and Maintenance Plan shall be <br />incorporated as part of the WQMP and shall include, at a minimum, <br />inspection and maintenance of all structural BMPs on the property, a report <br />of non-structural BMP inspection and compliance, and reporting <br />requirements. The Monitoring and Maintenance Plan must be approved by <br />the City of Pleasanton City Engineer prior to the beginning of occupancy. <br />The Monitoring and Maintenance Plan can be administered through lease <br />agreements assigning responsibility to the occupants, through the creation <br />of a Community Services Authority (CSA) or by other means as approved <br />by the City. If property titles are transferred, the new owner shall be <br />responsible for their respective portion of the plan. <br />21. Water Supply. Prior to tentative map approval for the Staples Ranch Site, <br />sufficient water supply for the Staples Ranch Site must be verified by the <br />City of Pleasanton as described in EIR mitigation measure WS -1.1. The <br />water supply verification must include documentation of historical water <br />deliveries for the previous 20 years, as well as a description of reasonably <br />foreseeable impacts of the proposed subdivision on the availability of water <br />resources of the region. <br />22. Deed Disclosures. Property owners shall include deed riders/disclosures <br />about the Livermore Municipal Airport consistent with Business and <br />Professions Code Section 11010 and Civil Code Sections 1102.6, 1103.4, <br />and 1353. <br />23. EIR Mitigation Monitoring. <br />a. If it is determined through field inspections and/or monitoring that a <br />site is not in compliance with an EIR mitigation/improvement <br />measure, the responsible party for implementation of the mitigation/ <br />improvement measure is the responsible party to bring the mitigation/ <br />improvement measure into compliance. The responsible party is <br />listed in the EIR Mitigation Monitoring and Reporting Plan. The City <br />of Pleasanton may require the responsible party to conduct a peer <br />review report by a consultant chosen by the City of Pleasanton to <br />determine compliance and to recommend measures to correct <br />noncompliance. All peer review costs shall be borne by the party <br />responsible for the implementation of the mitigation/improvement <br />measure. <br />19 <br />
