by the State of California as containing aggregate and mineral <br />resources of regional significance. Operations and reclamation <br />activities at the Quarry Lands are projected to continue until at least <br />2030. Quarry operations may result in airborne particulate matter, <br />bright lights, noise and vibration, unattractive visual appearance, and <br />heavy truck traffic. EI Charro Road serves as the main access route <br />to the Quarry Lands and is subject to a high volume of heavy truck <br />traffic related to the Quarry Lands. <br />(iii.) All property owners shall attach the following rider to each deed for any <br />property within the Staples Ranch Site: <br />Grantee hereunder acknowledges and agrees that the subject property <br />is located in the vicinity of active and operating quarries and <br />processing facilities. Grantee also acknowledges that quarry <br />operations may result in airborne particulate matter, bright lights, noise <br />and vibration, unattractive visual appearance, and heavy truck traffic <br />on EI Charro Road and adjacent streets and roadways within or <br />outside the quarries. Grantee accepts possible inconvenience of <br />discomfort from any of the foregoing and Grantee hereby <br />acknowledges and agrees that no claim of nuisance shall lie based on <br />any of the foregoing. Grantee hereby covenants to include this same <br />paragraph, in its entirety, in any subsequent deed by Grantee of all or <br />any portion of the subject property. Grantee further covenants to <br />include this same paragraph within any lease for all or any portion of <br />the subject property. {Pre Developrnent and Cooperatiobn `Agreemer` }; <br />D. Code, General Plan, and Permits <br />Attention Getting Devices. At no time shall balloons, banners, pennants, or other <br />attention getting devices be utilized on the site except as allowed by <br />Section 18.96.060.K of the Zoning Ordinance for grand openings or by Section <br />18.116.040 of the Zoning Ordinance if approved as part of a temporary conditional <br />use permit. At no time shall spot lighting be used in conjunction with such grand <br />openings and/or promotional events. <br />2. Grand Openings. Temporary signs, banners, pennants, and decorations shall be <br />allowed subject to the requirements of Section 18.96.060.K of the Pleasanton <br />Municipal Code. <br />3. Noise. Except as otherwise modified by the conditions of approval for this case, <br />compliance with the City's noise standards shall be achieved. <br />4. Airport Protection Area Boundary. Dwelling units shall not be located east of <br />the Airport Protection Area (APA) line for the Livermore Municipal Airport adopted <br />by the Alameda County Airport Land Use Commission in 1993.
