EXHIBIT A <br />CONDITIONS OF APPROVAL <br />Vesting Tentative Map Tract 8004, Ponderosa Homes II, Inc. <br />1 Reimers Drive <br />April 15, 2009 <br />Vesting Tentative Map Tract 8004 shall be as shown on the vesting <br />tentative map plans and related exhibits, Exhibit B, dated "Received" <br />March 20, 2009, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the <br />Director of Community Development if found to be in substantial <br />conformance to the approved exhibits. <br />2. All conditions of PUD -74 shall remain in full force and effect. <br />3. This subdivision map approval will lapse and become void two years from <br />the date of approval unless a final subdivision map has been recorded or <br />an extension has been approved by the City. <br />4. Final approval of all utility systems, grading, streets, drainage, and other <br />improvements shall be subject to final review and approval of the <br />Engineering Division. <br />5. Prior to issuance of any grading or on-site permits, the applicant shall <br />provide the City with written agreements from the City, Zone 7, and <br />Legacy Partners, or their successors, for the proposed off-site <br />improvements on these properties. If the applicant is unable to obtain <br />agreements from the adjacent owners, then the applicant may eliminate <br />the off-site improvements on one or both of the properties and revise the <br />improvement plans to conform to the PUD -74 development plan. The <br />agreements shall address maintenance of the improvements in the off-site <br />areas. If the adjacent property owners will not maintain these areas, then <br />the applicant shall include these areas (except the public trail and related <br />improvements) as part of the maintenance responsibilities of the <br />homeowners association. Agreements for the maintenance of the public <br />trail located on the adjacent property owners' land shall be executed per <br />the review and approval of the Director of Community Development and <br />the City Attorney. <br />6. Prior to issuance of any grading or on-site permits, the applicant shall <br />obtain all applicable Alameda County approvals for the proposed <br />improvements located outside of City limits. Copies of said approvals <br />shall be provided to the City. If the applicant is unable to obtain the <br />applicable County approvals for the improvements located outside of City <br />
