EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PUD -77, Dutra Trust <br />1053 Happy Valley Road <br />January 14, 2009 <br />General Conditions: <br />The Proposed Planned Unit Development plan shall be substantially following the <br />documents on file, list below as Exhibit A, dated "Received September 5, 2008," <br />on file with the Planning Division, except as modified by the following conditions. <br />Minor changes to the plans may be allowed subject to the approval of the <br />Director of Community Development if found to be in substantial conformance to <br />the approved exhibits. <br />• Site Plan and Grading Plan <br />• Design Guidelines <br />• Habit Assessment for the California Tiger salamander and the California <br />Red -Legged Frog by Olberding Environmental, Inc. <br />• Biological Resources Analysis by Olberding Environmental, Inc. <br />• U.S. Army Corps of Engineers Wetland Delineation by Olberding <br />Environmental, Inc. <br />• Tree Report by HortScience <br />• Preliminary Geotechnical and Geologic Investigation by TRC Lowney <br />• Geotechnical and Geologic Investigation by Cornerstone Earth Group <br />• Alan Kropp & Associates peer review comments <br />2. Uses allowed and conditionally allowed within this PUD shall be subject to those <br />of the Semi -Rural Density Residential (PUD-SRDR) District of the Happy Valley <br />Specific Plan. <br />3. The project developer shall pay any and all fees to which the property may be <br />subject prior to issuance of building permits. The type and amount of the fees <br />shall be those in effect at the time the building permit is issued. <br />4. The project developer shall fund this development's pro -rata share of the <br />infrastructure improvement costs specified in the Happy Valley Specific Plan and <br />the City's adopted sewer/water policies for the Happy Valley area. All <br />water/sewer main extensions shall be at the full cost of the project developer; <br />however, the project developer may be entitled to reimbursement in the event <br />this cost exceeds its share as established in the above -listed programs. Final <br />resolution of this project's obligations/requirements shall be made prior to the <br />approval of a tentative subdivision map covering these units. <br />
