The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The existing indoor recreation facility is located in a commercial area that has a variety of retail businesses, including but not limited to general retail shops, franchise businesses, restaurants, etc. As conditioned, serving beer and wine to adult patrons would not generate any adverse impacts upon adjacent other businesses and patrons. Furthermore, the serving of beer and wine has been conditioned to adhere to all requirements of the Alcohol and Beverage Control agency. A condition of approval has been added to allow the review and possible revocation of this use permit should there be any adverse impacts on the public health, safety, and general welfare. Thus, this second finding can be made. 3. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. Based on the proposal and analysis of this proposed use, granting a conditional use permit to the proposed use would be consistent with the City's ability to regulate zoning regulations. Therefore, this third finding can be made. WHEREAS, the Planning Commission determined that the proposed conditional use would be compatible with the existing uses in the area. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-203, the application of Big Valley, LP/Anderson- Siprashvili Music Academy for a conditional use permit to conduct piano and guitar instruction Monday through Friday from 3:30 p.m. to 8:30 p.m., including private lessons and classes for two to four students within an existing industrial building located at 1258 Quarry Lane, subject to the conditions shown in Exhibit B, attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
