Resolution No. PC -2008-34 <br />Page Two <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />The existing indoor recreation facility is located in a commercial area that has a variety <br />of retail businesses, including but not limited to general retail shops, franchise <br />businesses, restaurants, etc. As conditioned, serving beer and wine to adult patrons <br />would not generate any adverse impacts upon adjacent other businesses and patrons. <br />Furthermore, the serving of beer and wine has been conditioned to adhere to all <br />requirements of the Alcohol and Beverage Control agency. A condition of approval has <br />been added to allow the review and possible revocation of this use permit should there <br />be any adverse impacts on the public health, safety, and general welfare. Thus, this <br />second finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />Based on the proposal and analysis of this proposed use, granting a conditional use <br />permit to the proposed use would be consistent with the City's ability to regulate zoning <br />regulations. Therefore, this third finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use <br />would be compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-203, the application of Big Valley, LP/Anderson- <br />Siprashvili Music Academy for a conditional use permit to conduct piano <br />and guitar instruction Monday through Friday from 3:30 p.m. to 8:30 p.m., <br />including private lessons and classes for two to four students within an <br />existing industrial building located at 1258 Quarry Lane, subject to the <br />conditions shown in Exhibit B, attached hereto and made part of this case <br />by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
