PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-34 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR <br />SHERMAN BALCH, SUPERFRANKS, AS FILED UNDER CASE PCUP-222 <br />WHEREAS, Sherman Balch, SuperFranks, has applied for a conditional use permit to <br />serve wine and beer in conjunction with food in an existing indoor <br />recreation facility located at 5341 Owens Court; and <br />WHEREAS, zoning for the property is PUD -C (Planned Unit Development — <br />Commercial) District; and <br />WHEREAS, at its duly noticed public hearing of July 9, 2008, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of <br />the City staff concerning this application; and <br />WHEREAS, This project is categorically exempt from environmental review pursuant to <br />California Environmental Quality Act Guidelines, Section 15301, Existing <br />Facilities, Class 1; and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and ensuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The proposed use is an incidental use to an existing indoor recreation facility <br />where there is a food service area. As required by the conditions, the food service staff <br />at the facility is required to undergo a training program such as TIPS (Training for <br />Intervention Procedures) that is designed to prevent intoxication, underage drinking, <br />and drunk driving. Based on the proposal and discussion in the staff report concerning <br />land use, no potential adverse land use issues would result from the proposed beer and <br />wine served at the food service area. Thus, this first finding can be made. <br />
