<br />91. Prior to Final Map approval, the developer shall install the electronic gate and gate <br />lighting required in condition number 12 and shall install a cattle guard near the <br />hammerhead by the entrance to the East Bay Regional Park District land. The lo- <br />cation and design of the cattle guard is subject to the review and approval of the <br />Planning Department and the East Bay Regional Park District. <br /> <br />92. Prior to Final Map approval, the developer shall establish a maintenance agree- <br />ment for the project. The agreement shall designate responsibilities for maintain- <br />ing all common private utilities, private streets, emergency vehicle accesses, all <br />street trees, all trees required to be preserved as shown on Exhibit "A", the land- <br />scape area between Foothill Road and the frontage road, the area within ten (10) <br />ft. of the snake wall (west of the snake wall only) and the snake wall, the native <br />landscaping strip on the north side of the northern private road required in condi- <br />tion # 18, and the five valley oak trees required in condition # 15 and the ten coast <br />live oak trees required in condition #17 until such time as the City's Landscape Ar- <br />chitecture determines that these trees have become successfully established. The <br />City shall be granted the rights and remedies of the association, but not the obliga- <br />tion, to enforce the maintenance obligations. The City Attorney shall review and <br />approve the proposed maintenance agreement prior to the recordation of a Final <br />Map for the project. <br /> <br />93. The developer shall provide a bond to the City guaranteeing the installation of all <br />private streets, street trees, shrubs, and all common infrastructure improvements <br />shown on the approved development plan or otherwise required as part of this de- <br />velopment. The developer shall provide an itemized cost estimate of said im- <br />provements, to be submitted with the bond, for the review and approval the <br />Planning Director and City Engineer prior to approval of the Final Map. The bond <br />shall be returned to the developer upon acceptance by the City of all required pub- <br />lic improvements. <br /> <br />Disclosures <br /> <br />94. The developer shall provide all home/lot buyers with copies of the project condi- <br />tions of approval. <br /> <br />95. The developer shall give notice to the home buyers through deed recordation, sat- <br />isfactory to the City Attorney and the East Bay Regional Park District, that the <br />property to the north and west of the PUD is a regional parkland and may have <br />park, open space, recreation uses, and/or grazing as determined by the East Bay <br /> <br />Page 16 <br />
