ATTACHMENT 1 <br /> COOPERATIVE AGREEMENT <br /> BETWEEN <br /> ALAMEDA COUNTY TRANSPORTATION COMMISSION <br /> AND <br /> CITY OF PLEASANTON <br /> Route 84 Widening Project—Pigeon Pass to Interstate 680 <br /> This COOPERATIVE AGREEMENT ("Agreement"), dated for reference purposes only as of <br /> October_, 2017, is entered into by and between the City of Pleasanton("City"), a municipal <br /> corporation, and Alameda County Transportation Commission("Alameda CTC"), a joint powers <br /> agency. This Agreement shall become effective on the date the same is fully-executed by both <br /> parties ("Effective Date"). <br /> RECITALS <br /> A. City as one of the members of the Tri Valley Transportation Council ("TVTC") is a <br /> signatory to the Joint Exercise of Powers Agreement Pertaining to the Tri-Valley <br /> Transportation Development Fee (TVTDF) for Traffic Mitigation. <br /> B. TVTDF fees are divided into the "Eighty Percent Fees" which are allocated by TVTC to <br /> projects in the TVTDF Funding Plan, and the "Twenty Percent Fees" a portion of which <br /> are available to the City for allocation to projects at its discretion. <br /> C. TVTC has identified the Project(defined as Route 84 Expressway(I-580 to I-680)) as one <br /> of eleven projects which it proposes to fund in part with the "Eighty Percent Fee"portion <br /> of the developer fees. <br /> D. The Project is divided into five segments: Segment 1 —1-580 to Jack London Boulevard, <br /> Segment 2—Jack London Boulevard to a point roughly halfway between Concannon <br /> Boulevard and Stanley Boulevard, Segment 3 —Halfway between Concannon Boulevard <br /> and Stanley Boulevard to Ruby Hill Drive, Segment 4—Ruby Hill Drive to Pigeon Pass, <br /> Segment 5 —Pigeon Pass to I-680. <br /> E. TVTC allocated $12 million TVTDF funds at a future date for engineering design, right of <br /> way acquisition and construction for Segment 5. <br /> F. City is a co-sponsor of the Project, along with the City of Livermore. <br /> G. Alameda CTC will be the implementing agency for engineering design and construction <br /> for Segment 5. <br />
