<br />19. All fencing located on the south side of Lots I and 4 of the Gooch property (PUD-99-8) shall be located <br />behind (north side) the landscape berm along Vineyard Avenue so as not to be visible from Vineyard Avenue. <br /> <br />Noise <br /> <br />20. All four new homes on the Gooch property where projected noise levels exceed an Loo of 55 dBA shall be <br />constructed with a fresh-air ventilation and/or air-conditioning system that allows residents to maintain closed <br />windows for noise and dust control. All windows facing the RMC Lonestar plant shall be dual-paned. <br /> <br />21. The recorded deed of sale for all shall include a clause which states that the property is in an area subject to <br />excessive noise, dust, and vibration levels from gravel harvesting and processing and that the City of <br />Pleasanton is not liable for possible damages due to such impacts. A noise/dust/vibration easement shall be <br />provided in the recorded deed of sale. A separate disclosure statement shall be provided to prospective <br />purchasers and tenants by lot owners and future successors in interest disclosing the potential future mining <br />operations within the Specific Plan area. The recorded deed of sale shall also include a disclosure statement <br />indicating the proximity of the Plan Area to the Livermore Municipal Airport and the possible impacts due to <br />aircraft overflights. <br /> <br />Construction Practices and Activities <br /> <br />22. All site improvements and house construction activities shall be limited to the hours of 8:00 a.m. to 5:00 p.m., <br />Monday through Friday. All construction equipment must meet DMV noise standards and shall be equipped <br />with muming devices. <br /> <br />23. Prior to the grading of an area larger than one acre in size, or when a tree with a trunk diameter greater than <br />six inches is to be removed during the raptor-nesting season (February I to August 31), a focused survey for <br />raptor nests shall be conducted by a qualified biologist during the nesting season. The survey shall be <br />conducted for no less than 14 days and no more than 30 days prior to the commencement of grading or tree <br />removal. If nesting raptors are found during the focused survey, no grading or tree removal shall occur within <br />500 feet of an active nest until the young have fledged (as determined by a qualified biologist), or until the <br />project applicant receives written authorization from CDFG to proceed. If the removal of nest trees is <br />unavoidable, they shall be removed during the non-breeding season. <br /> <br />24. Prior to the commencement of grading, the developer shall submit a projected timeline for the completion of <br />grading and construction of the widened Clara Lane to the owner ofthe Elgamal parcel and all other residents <br />that currently use Clara Lane as an access to their homes. The developer shall be responsible for and make all <br />reasonable efforts to ensure that these residents are provided an access to their homes at all times during the <br />construction ofthis project. <br /> <br />25. At no time shall campers, trailers, motor homes, or any other vehicle be used as living or sleeping quarters on <br />the construction site. All such vehicles shall be removed from the site at the end of each work day. <br /> <br />26. The haul route for all materials to and from this development shall be approved by the City Engineer prior to <br />the issuance of an encroachment permit. <br /> <br />27. If archeological materials are uncovered during grading, trenching, or other on-site excavation, all work on <br />site shall be stopped and the City immediately notified. The county coroner and the Native American <br />Heritage Commission shall also be notified and procedures followed as required in Appendix K ofthe <br />California Environmental Quality Act. A similar note shall appear on the improvement plans. <br /> <br />28. Portable toilets used during construction shall be kept as far as possible from existing residences and shall be <br />emptied on a regular basis as necessary to prevent odor. <br />
