<br />Resolution No. PC-99-62 <br />Page 2 <br /> <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Due to the size limitation of the second unit, the traffic generation would not be <br />any greater than that of a single-family residence. The proposed number of <br />parking spaces exceed that required by the Municipal Code and the Ruby Hill <br />Design Guidelines. One uncovered parking space will be reserved for the <br />occupant(s) of the second unit. Guest parking spaces would be provided within <br />the circular driveway in front of the residence. Because of the size limit of the <br />second unit and the limit on the number of adu1ts which could reside in it, there <br />will be little or no impact on parking or utilities. The second unit has been <br />integrated within the existing residence, and the design matches that of the main <br />dwelling, and, therefore, the second unit wou1d be compatible with the <br />neighborhood and would not be detrimental to the public health, safety, and <br />welfare. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />As proposed and conditioned, the use complies with all applicable regulations of <br />the Zoning Ordinance including regulations pertaining to height, floor area, <br />setbacks, etc. Granting a conditional use permit to the applicants is, therefore, <br />consistent with the City's Zoning Ordinance. <br /> <br />WHEREAS, the Planning Commission determined that the proposal is in compliance with <br />State law and the required findings for a conditional use permit can be met. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-99-34, the application of Etienne DeGroot for a conditional <br />use permit to allow a 693-square-foot second unit within a single-family residence <br />located at 1105 Via Di Salerno, subject to the conditions shown in Exhibit "B," <br />attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
