Resolution No. PC-99-62
Page 2

2. The proposed location of the conditional use and the conditions under
which it would be operated or maintained will not be detrimental to the
public health, safety, or welfare, or materially injurious to the properties or
improvements in the vicinity.

Due to the size limitation of the second unit, the traffic generation would not be
any greater than that of a single-family residence. The proposed number of
parking spaces exceed that required by the Municipal Code and the Ruby Hill
Design Guidelines. One uncovered parking space will be reserved for the
occupant(s) of the second unit. Guest parking spaces would be provided within
the circular driveway in front of the residence. Because of the size limit of the
second unit and the limit on the number of adu1ts which could reside in it, there
will be little or no impact on parking or utilities. The second unit has been
integrated within the existing residence, and the design matches that of the main
dwelling, and, therefore, the second unit wou1d be compatible with the
neighborhood and would not be detrimental to the public health, safety, and
welfare.

3. The proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance.

As proposed and conditioned, the use complies with all applicable regulations of
the Zoning Ordinance including regulations pertaining to height, floor area,
setbacks, etc. Granting a conditional use permit to the applicants is, therefore,
consistent with the City's Zoning Ordinance.

WHEREAS, the Planning Commission determined that the proposal is in compliance with
State law and the required findings for a conditional use permit can be met.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
RESOLVES THE FOLLOWING:

Section 1.

Approves Case UP-99-34, the application of Etienne DeGroot for a conditional
use permit to allow a 693-square-foot second unit within a single-family residence
located at 1105 Via Di Salerno, subject to the conditions shown in Exhibit "B,"
attached hereto and made part of this case by reference.

Section 2.

This resolution shall become effective 15 days after its passage and adoption
unless appealed prior to that time.
