<br />8. Prior to issuance of a building permit, the project developer shall pay the applicable Zone <br />7 and City connection fees and water meter cost for any water meters, including irrigation <br />meters. Additionally, the developer shall pay any applicable Dublin San Ramon Services <br />District (DSRSD) sewer permit fee. <br /> <br />9. This approval does not guarantee the availability of sufficient water to serve the project. <br />The City shall withhold building permits for the project if at the time building permits are <br />applied for, mandatory water rationing is in effect, unless the City has adopted a water <br />offset program and unless the developer is participating in the program. Notwithstanding <br />the developer's participation in such a program, the City may withhold building permits if <br />the City determines that sufficient water is not available at the time of application of <br />building permits. <br /> <br />10. If any operation(s) of the uses on the sites or in the buildings covered by this approval <br />results in conflicts pertaining to parking, noise, traffic, or other impacts, at the discretion <br />of the Planning Director, this approval may be referred to the Planning Commission for <br />subsequent review at a public hearing. Ifnecessary, the Commission may modify or add <br />conditions of approval to mitigate such impacts. <br /> <br />II. Trucks serving the subject businesses and uses shall not exceed a gross vehicle weight of <br />40,000 pounds until an alternative truck route is identified an approved by the City of <br />Pleasanton. Depressed loading docks will be considered by the Planning Director once an <br />alternative truck route is implemented. <br /> <br />12. The project developer shall record CC&R's at the time of recordation of a final <br />parcel/subdivision map which shall create a property owners association for the <br />development. The property owners association shall be responsible for the following: <br /> <br />a. Maintenance of Boulder Court, a private street; <br /> <br />b. Maintenance of all common private utilities and other common facilities; <br /> <br />c. All landscaping extending to the face-of-curb on Boulder Court and Boulder Street; <br /> <br />d. Implementing all storm water measures and for the maintenance of all private utili- <br />ties, landscaping, and other common areas and facilities on the site. <br /> <br />The CC&R's shall be subject to the review and approval of the City Attorney prior to <br />recordation of the final map.
