<br />Resolution No. PC-99-5l <br />Page 2 <br /> <br />For safety reasons and to deter theft and accidents, Taylor Enterprises has <br />agreed to limit the number of firearms stored on site (to a maximum of <br />ten) and to lock up all firearms in an on-site safe in an alarmed storage <br />room. <br /> <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The residential uses closest to Taylor Enterprises are single-family <br />residences. It is unlikely that firearm and miscellaneous police equipment <br />sales at Taylor Enterprises would impact the single-family residences due <br />to their location since Taylor Enterprises is located in a major <br />industrial/office business park, not a neighborhood shopping center, and <br />based on the separation between uses. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />The applicant has indicated that he is complying with the City's Saturday <br />Night Special and trigger lock requirements, and a recommended <br />condition of approval requires that a trigger lock be provided with all <br />firearms sold. As operated and conditioned, the firearm and miscellaneous <br />police equipment sales would be in compliance with all other applicable <br />chapters of the Zoning Ordinance. <br /> <br />4. The characteristics ofthe proposed use are sufficiently similar to a allowed <br />use in the zoning district to justify a finding that the proposed use should <br />also be allowed. <br /> <br />The applicant's business is small-scale. The business owner and his wife <br />are the only employees of the business and few goods are stored on site. <br />The ultimate consumer of the goods makes an appointment with the <br />applicant to order the goods and likewise makes an appointment with the <br />applicant to receive the goods when they are ready for purchase. A <br />condition has been added which limits the number of customers the <br />applicant can see in a week to a maximum of five. All business <br />transactions at the site would occur between 8:00 a.m. and 5:00 p.m. <br />which are normal business hours. The business characteristics listed above <br />are similar to those of a small wholesale establishment and other small <br />retail establishments in which the goods are sold to the ultimate consumer <br />or are made to the customer's specifications. These types of uses are <br />allowed uses in Bernal Corporate Park. <br />
