Resolution No. PC-99-5l Page 2 For safety reasons and to deter theft and accidents, Taylor Enterprises has agreed to limit the number of firearms stored on site (to a maximum of ten) and to lock up all firearms in an on-site safe in an alarmed storage room. 2. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The residential uses closest to Taylor Enterprises are single-family residences. It is unlikely that firearm and miscellaneous police equipment sales at Taylor Enterprises would impact the single-family residences due to their location since Taylor Enterprises is located in a major industrial/office business park, not a neighborhood shopping center, and based on the separation between uses. 3. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. The applicant has indicated that he is complying with the City's Saturday Night Special and trigger lock requirements, and a recommended condition of approval requires that a trigger lock be provided with all firearms sold. As operated and conditioned, the firearm and miscellaneous police equipment sales would be in compliance with all other applicable chapters of the Zoning Ordinance. 4. The characteristics ofthe proposed use are sufficiently similar to a allowed use in the zoning district to justify a finding that the proposed use should also be allowed. The applicant's business is small-scale. The business owner and his wife are the only employees of the business and few goods are stored on site. The ultimate consumer of the goods makes an appointment with the applicant to order the goods and likewise makes an appointment with the applicant to receive the goods when they are ready for purchase. A condition has been added which limits the number of customers the applicant can see in a week to a maximum of five. All business transactions at the site would occur between 8:00 a.m. and 5:00 p.m. which are normal business hours. The business characteristics listed above are similar to those of a small wholesale establishment and other small retail establishments in which the goods are sold to the ultimate consumer or are made to the customer's specifications. These types of uses are allowed uses in Bernal Corporate Park.
