<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-51 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF FOREST T. TAYLOR FOR A <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-99-18 <br /> <br />WHEREAS, Forest T. Taylor has applied for a conditional use permit to allow the sale of <br />firearms and miscellaneous police equipment on an appointment only basis <br />located at 6920 Koll Center Parkway (Bernal Corporate Park), Suite #225; and <br /> <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - Industrial! <br />Commercial-Office) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of July 28, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />As conditioned, the use would be consistent with the general provisions of <br />the Zoning Ordinance. The general provisions of the Zoning Ordinance <br />state that the objective of the ordinance is to protect and to promote the <br />public health, safety, peace, comfort, convenience, prosperity and general <br />welfare. The intent of the firearm sales ordinance was to prohibit firearm <br />sales in residential neighborhoods and neighborhood commercial shopping <br />centers, to notifY the public where firearms are sold, to allow firearm sales <br />in typical regional shopping centers and in industrial/office type areas, and <br />to protect and promote the public safety by ensuring that the firearms are <br />stored, sold, and monitored in a way to deter theft, avoid accidents, and <br />promote public safety. The proposed use is located a safe distance away <br />from the single-family residences in a large industrial/office park which <br />meets the intent of the Firearm Sales Ordinance in regard to where <br />small-scale firearm sales should be located. <br />
