The use meets Code standards for the provision of off-street parking, and site visits have verified the availability of parking spaces. Except for a new sign, no changes would be made to the exterior of the structure, and no part of the use would be conducted outdoors. C. The proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. The site's C-N zoning conditionally permits establishments very similar in nature to the tutoring service. Per Section 18.44.090 C ofthe Municipal Code, the Planning Commission can make the finding that the use is conditionally permitted in the C-N District even though not specifically listed in Table 18.44.090 of the Municipal Code. WHEREAS, the Planning Commission determined that the proposed tutoring service would be compatible with all of the surrounding uses and is appropriate for the site. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-99-28, the application of Score! Learning Corporation for a conditional use permit to establish a children's tutoring service located at 5424 Sunol Boulevard, Suite 11, subject to the conditions shown in Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
