<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-50 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF SCORE! LEARNING <br />CORPORATION FOR A CONDITIONAL USE PERMIT, AS FILED UNDER CASE <br />UP-99-28 <br /> <br />WHEREAS, Score! Learning Corporation has applied for a conditional use permit to establish <br />a children's tutoring service located at 5424 Suno1 Boulevard, Suite 11; and <br /> <br />WHEREAS, zoning for the property is C-N (Neighborhood Commercial) District; and <br /> <br />WHEREAS, at its dilly noticed public hearing of July 28, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />One of the purposes of the Neighborhood Commercial district is to <br />provide locations which offer commodities and services to the surrounding <br />residents. The proposed business would provide an educational service to <br />the children in the community. In addition, other businesses in the Oak <br />Hills Shopping Center could potentially benefit from the presence of the <br />business in that they offer services and merchandise which may appeal to <br />the center's students or their parents. The conditions of approval proposed <br />for this project give the City the appropriate controls to ensure that the use <br />does not have any negative impacts on the surrounding uses. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />
