<br />such a program, the City may withhold building permits if the City determines that <br />sufficient water is not available at the time of application of building permits. <br /> <br />12. For Lot 10, any portion of the building projecting over the rear building pad line <br />shall be designed as a front-to-back, downhill split-pad configuration. <br /> <br />13. Lots 10 through 12 shall be reconfigured per Exhibit "C". The open space area <br />shall be incorporated with the open space area dedicated to the City. <br /> <br />14. The project developer shall record CC&R's at the time of recordation of the final <br />map which shall create a property owners association for the development. The <br />CC&R's shall be subject to the review and approval of the City Attorney prior to <br />recordation of the final map. The property owners association shall be responsible <br />for the following: <br /> <br />a. Maintaining the shared driveway for Lots 6 through 9. <br /> <br />b. Maintaining the landscape fire barrier to be located along the west side of the <br />public street/privat~ driveway opposite Lots 3 through 9 and along thl? south <br />side of Lot 9. <br /> <br />c. Maintaining the street trees located on private lots. <br /> <br />The City shall be granted the rights and remedies of the association, but not the ob- <br />ligation, to enforce the maintenance responsibilities of the property owners <br />association. <br /> <br />15. The project's design guidelines shall be modified to require two (2) twenty-four <br />inch (24") box street trees for each lot. Final editions of the guidelines shall be <br />submitted to the Planning Director with the tentative map. <br /> <br />16. A fire-resistant landscape barrier shall be provided on the slope banks located <br />along the westerly sides of Lots 10 through 12, on the slope bank directly adjoin- <br />ing the south side of Lot 9, and along the westerly side of the public street/private <br />driveway opposite Lots 3 through 8. The design location of the landscape areas lo- <br />cated off private lots would be reviewed with the tentative map; on private lots, it <br />would be reviewed with the individual design review applications. <br /> <br />PUD-99-07.
