<br />Resolution No. PC-99-44 <br />Page 2 <br /> <br />protect offices from the noise, disturbance, traffic hazards, safety hazards, <br />and other objectionable influences incidental to certain commercial uses. <br />As proposed, the school will not alter in any way the exterior ofthe office <br />building so as to detract from its architectural features. In addition, the <br />school expansion use will not interfere with surrounding uses' ability to <br />operate. The anticipated number of employees and students will not <br />generate any unusual demands on existing parking for the building or the <br />surrounding properties. As conditioned, the proposed use will be <br />compatible with adjacent office uses located within the building. The <br />applicants can also be required to mitigate future nuisances as a result of <br />the proposed use. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The proposed school classrooms will be contained completely within the <br />building on the site. Sufficient parking, ample traffic capacity, adequate <br />separation from the residential neighborhoods, maintenance of noise <br />levels, and safety and security within the premises have been provided or <br />conditioned. All streets around the site are designed per City standards to <br />provide safe ingress and egress into and out ofthe site. Furthermore, the <br />existing Carden West School has been operating from the subject property <br />for the past two years and from the adjacent church property for the past <br />ten years without any apparent adverse impacts on the surrounding uses. <br />Conditions have been included that would require the applicants to <br />mitigate future nuisances as a result ofthe proposed use. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The site's Office zoning conditionally permits the establishment of private <br />schools. In addition, the proposed use complies with all relevant sections <br />ofthe zoning ordinance. Granting a conditional use permit to the Carden <br />West School would be consistent with the City's ability to regulate zoning <br />as listed in the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, the Planning Commission determined that the proposed classrooms and increase <br />in the total number of students enrolled at the school can be accommodated <br />without creating adverse impacts on the adjacent properties or tenants, and is <br />acceptable. <br />
