<br />Resolution No. PC-99-42 <br />Page 2 <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Due to the size limitation ofthe secondary unit, the traffic generation for <br />the site should not be significantly greater than that of a single-family <br />residence. An off-street parking space would be provided for the <br />secondary unit. Because of the size limit of the secondary unit and the <br />limit on the number of adults which could reside in it, staff believes that <br />there will be little or no impact on the existing sewer and utility system. <br />The secondary unit would be complementary to the design of the main <br />dwelling unit. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />As proposed and conditioned, the use complies with all applicable <br />regulations of the zoning district in which the secondary unit is located. <br />Granting a conditional use permit to Jack Chestnut is consistent with the <br />City's ability to regulate zoning as listed in the Municipal Code Chapter <br />18.124. <br /> <br />WHEREAS, the Planning Commission determined that the proposal is in compliance with <br />State law. As conditioned, the proposal would maintain the character of the <br />existing single-family residence and there would be no impacts on adjacent <br />properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-98-76/Z-98-311, the application of Jack Chestnut for (I) <br />administrative design review approval to construct two, one-story additions <br />totaling approximately 260 square feet to an existing, approximately <br />413-square-foot, detached accessory structure (resulting in a total area of <br />approximately 673 square feet) located adjacent to the eastern side yard of the <br />property at 4128 Stanley Boulevard, and (2) conditional use permit approval to <br />establish a second unit within the same detached structure, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part ofthis case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
