PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-99-42

RESOLUTION APPROVING THE APPLICATION OF JACK CHESTNUT FOR
CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVALS, AS FILED
UNDER CASE UP-98-76/Z-98-3ll

WHEREAS, Jack Chestnut has applied for (1) administrative design review approval to
construct two, one-story additions totaling approximately 260 square feet to an
existing, approximately 413-square-foot, detached accessory structure (resulting
in a total area of approximately 673 square feet) located adjacent to the eastern
side yard of the property at 4128 Stanley Boulevard, and (2) conditional use
permit approval to establish a second unit within the same detached structure; and

WHEREAS, zoning for the property is R-I-20,OOO District; and

WHEREAS, at its duly noticed public hearing of June 23, 1999, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations of the
City staff concerning this application; and

WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Environmental Quality Act (CEQA); therefore, no environmental
document was prepared for this project; and

WHEREAS, the Planning Commission made the following findings:

A. The proposed location of the conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.

The request to establish a detached secondary unit on the site conforms
with the objectives and purposes ofthe zoning ordinance. A secondary
unit is considered to be a single-family use which is allowed in the
R-I-20,000 District. The proposal would maintain the existing
single-family character because the secondary unit has been designed to
integrate with the existing dwelling. In addition, a recommended
condition of approval -- standard for all secondary units in the City --
requires that either the primary residence or the secondary unit be
owner-occupied and that a maximum of two adu1ts shall be allowed to
reside in the secondary unit (plus any children) to maintain a low density
and traffic volume for the neighborhood.
