<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-42 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF JACK CHESTNUT FOR <br />CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVALS, AS FILED <br />UNDER CASE UP-98-76/Z-98-3ll <br /> <br />WHEREAS, Jack Chestnut has applied for (1) administrative design review approval to <br />construct two, one-story additions totaling approximately 260 square feet to an <br />existing, approximately 413-square-foot, detached accessory structure (resulting <br />in a total area of approximately 673 square feet) located adjacent to the eastern <br />side yard of the property at 4128 Stanley Boulevard, and (2) conditional use <br />permit approval to establish a second unit within the same detached structure; and <br /> <br />WHEREAS, zoning for the property is R-I-20,OOO District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 23, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a detached secondary unit on the site conforms <br />with the objectives and purposes ofthe zoning ordinance. A secondary <br />unit is considered to be a single-family use which is allowed in the <br />R-I-20,000 District. The proposal would maintain the existing <br />single-family character because the secondary unit has been designed to <br />integrate with the existing dwelling. In addition, a recommended <br />condition of approval -- standard for all secondary units in the City -- <br />requires that either the primary residence or the secondary unit be <br />owner-occupied and that a maximum of two adu1ts shall be allowed to <br />reside in the secondary unit (plus any children) to maintain a low density <br />and traffic volume for the neighborhood. <br />
