<br />Resolution No. PC-99-37 <br />Page 2 <br /> <br />The proposed use is located a safe distance away from the nearby <br />single-family residences since they are located on the opposite side of the <br />major arterial, Santa Rita Road, since the homes back up to Santa Rita <br />Road and an eight foot high sound wall is located along their rear property <br />lines, and since Outdoor World is set back approximately 240 feet from <br />Santa Rita Road. Furthermore, Outdoor World is located in a large <br />regional retail complex which conforms to the intent ofthe firearm sales <br />ordinance. Several conditions have been added to deter theft, thus limiting <br />the potential negative impacts to nearby residences, including the senior <br />care facility. Therefore, it is unlikely that firearm sales at Outdoor World <br />would negatively impact nearby residences. <br /> <br />In order to further address safety issues, a condition of approval has been <br />added that Outdoor World put up a legible, highly visible sign in the <br />firearm display area which states that minors who are not accompanied by <br />an adult are not allowed to handle firearms or ammunition and are not <br />allowed to loiter in firearm display area. A condition of approval requires <br />that Outdoor World strictly enforce this policy and ask for identification of <br />persons in the display area who appear to be under age 21. <br /> <br />For safety reasons and to deter theft and accidents, Outdoor World has <br />agreed to monitor the firearm display area with a video camera and, to <br />have the City Police Department do a background check on all employees <br />with keys to the displays and who do the final paper work for firearm <br />sales. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The residential uses closest to Outdoor World are single-family residences <br />and an approved senior care facility. It is unlikely that firearm sales at <br />Outdoor World would impact the single-family residences and senior care <br />facility due to their location since Outdoor World is located in a major <br />retail center, not a neighborhood center, and based on the separation <br />between uses, as described above. Similarly, as operated and conditioned, <br />adequate safety measures would be provided to aid in deterring theft and <br />ensuring safety. For these reasons, the proposed operation would not be <br />detrimental to the public health, safety, and welfare, or potentially <br />injurious to properties or improvements in the vicinity. <br />
