<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-37 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF BOB THOMAS/OUTDOOR <br />WORLD, INC. FOR A CONDITIONAL USE PERMIT, AS FILED UNDER CASE <br />UP-99-08 <br /> <br />WHEREAS, Bob Thomas/Outdoor World, Inc. has applied for a conditional use permit to <br />allow the sale of firearms within the existing retail store located at 3903 Santa <br />Rita Road (Rose Pavilion Shopping Center); and <br /> <br />WHEREAS, zoning for the property is Planned Unit Development (PUD) - C (Commercial) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearing of May 26,1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The use would be consistent with the general provisions of the Zoning <br />Ordinance. The general provisions of the Zoning Ordinance state that the <br />objective of the ordinance is to protect and to promote the public health, <br />safety, peace, comfort, convenience, prosperity and general welfare. The <br />intent of the firearm sales ordinance was to prohibit firearm sales in <br />residential neighborhoods and neighborhood commercial shopping <br />centers, to notify the public where firearms are sold, to allow firearm sales <br />in typical regional shopping centers and in industrial/office type areas, and <br />to protect and promote the public safety by ensuring that the firearms are <br />stored, sold, and monitored in a way to deter theft, avoid accidents, and <br />promote public safety. <br />
