PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-99-37 RESOLUTION APPROVING THE APPLICATION OF BOB THOMAS/OUTDOOR WORLD, INC. FOR A CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-99-08 WHEREAS, Bob Thomas/Outdoor World, Inc. has applied for a conditional use permit to allow the sale of firearms within the existing retail store located at 3903 Santa Rita Road (Rose Pavilion Shopping Center); and WHEREAS, zoning for the property is Planned Unit Development (PUD) - C (Commercial) District; and WHEREAS, at its duly noticed public hearing of May 26,1999, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this application; and WHEREAS, projects ofthis nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); therefore, no environmental document was prepared for this project; and WHEREAS, the Planning Commission made the following findings: A. The proposed location of the conditional use is in accordance with the objectives of the zoning ordinance and the purpose of the district in which the site is located. The use would be consistent with the general provisions of the Zoning Ordinance. The general provisions of the Zoning Ordinance state that the objective of the ordinance is to protect and to promote the public health, safety, peace, comfort, convenience, prosperity and general welfare. The intent of the firearm sales ordinance was to prohibit firearm sales in residential neighborhoods and neighborhood commercial shopping centers, to notify the public where firearms are sold, to allow firearm sales in typical regional shopping centers and in industrial/office type areas, and to protect and promote the public safety by ensuring that the firearms are stored, sold, and monitored in a way to deter theft, avoid accidents, and promote public safety.
