<br />Resolution No. PC-99-30 <br />Page 2 <br /> <br />There would be adequate parking available for the employees and <br />customers of the proposed veterinary clinic during its operation. The <br />location of the proposed veterinary clinic would provide adequate <br />separation from the rear yards of nearby single family homes, and a <br />masonry wall separates the shopping center from the residences. Deceased <br />animals and surgically removed tissue would be frozen and stored within <br />the clinic until taken off-site for cremating, thus eliminating the potential <br />for odor or inappropriate disposal of biological material. Animal litter <br />would be sealed in double plastic bags and stored within an existing trash <br />enclosure located approximately 55' 0" from existing single family homes. <br />Additional sound insulation would be installed with construction of the <br />veterinary clinic, insulating it from adjacent tenant spaces. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The proposed conditional use is required to comply with all applicable <br />sections of the Pleasanton Municipal Code governing the subject property. <br />By complying with the recommended conditions of approval, the proposed <br />establishment would meet the criteria for receiving a conditional use <br />permit and would, therefore, comply with the intent of the zoning <br />ordinance. <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use is <br />compatible with the existing commercial and residential uses surrounding the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-99-7, the application of Larry Gilman, D.V.M. and Susan <br />Marshall, D.V.M. for a conditional use permit to allow the operation of a <br />veterinary clinic for cats only with incidental overnight boarding and an adoption <br />service located at 3160 Santa Rita Road, Suite B I, in the Santa Rita Square <br />Shopping Center, subject to the conditions shown in Exhibit "B," attached hereto <br />and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
