<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-30 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF LARRY GILMAN, D.V.M. <br />AND SUSAN MARSHALL, D.V.M. FOR A CONDITIONAL USE PERMIT, AS <br />FILED UNDER CASE UP-99-7 <br /> <br />WHEREAS, Larry Gilman, D.V.M. and Susan Marshall, D.V.M. have applied for a conditional <br />use permit to allow the operation of a veterinary clinic for cats only with <br />incidental overnight boarding and an adoption service located at 3160 Santa Rita <br />Road, Suite B 1, in the Santa Rita Square Shopping Center; and <br /> <br />WHEREAS, zoning for the property is Planned Unit Development (PUD) - C (Commercial) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearing of April 14, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The proposed veterinary clinic is a commercial use proposed to be located <br />in an existing commercial shopping center having a variety of commercial <br />uses and services. The cats only clinic would provide service to residents <br />in the area, in accordance with Zoning Ordinance objectives. All activities <br />associated with the proposed veterinary clinic would be operated indoors <br />making it, in staffs opinion, compatible with nearby commercial and <br />residential uses. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />
