The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Due to the size limitation of the second unit, the traffic generation would <br />not be any greater than that of a single-family residence. Since the home <br />will have three off-street parking spaces, although only two are required <br />by Code, it is suggested that the proposed uncovered parking space be <br />reserved for the occupant(s) of the second unit. Guest parking spaces <br />would be provided within the main driveway and on the street directly in <br />front of and on the side of the residence. Because of the size limit of the <br />second unit and the limit on the number of adults which could reside in it, <br />there will be little or no impact on parking or utilities. The second unit has <br />been integrated within the existing residence, and the design matches that <br />of the main dwelling. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />As proposed and conditioned, the use complies with all applicable <br />regulations of the Zoning Ordinance including regulations pertaining to <br />height, floor area, setbacks, etc. Granting a conditional use permit to the <br />applicants is therefore consistent with the City's Zoning Ordinance. <br /> <br />WHEREAS, the Planning Commission determined that the proposal is in compliance with <br />State law and that, as conditioned, the proposal would maintain the character of <br />the existing single-family residence and there would be no impacts on adjacent <br />neighbors. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-98-51, the application of Karen and Farhad Sabetan for a <br />conditional use permit to allow an attached second unit approximately 420 square <br />feet in floor area within an existing residence located at 6259 Corte Fuego, subject <br />to the conditions shown in Exhibit "B," attached hereto and made part of this case <br />by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
